Aurigny is the airline of Guernsey. We travelled with them on Sunday back to Gatwick but was delayed for over 5 hours. They state on their site that because they are not based in the EU and the flights do not originate in the EU they are not liable under this EU regulation.
They had to charter an aircraft which came from Stansted via Gatwick, to pick up passengers for Guernsey before taking us on the return trip back to Gatwick.
I therefore feel that this flight originated in the UK and returned to the UK.
Has anyone got any experience they can throw my way please.

Guernsey is not in the EU, therefore the return flight did not originate in the EU any more than if you were flying back from Miami, irrespective of where the outbound flight came from. Presumably the airline is registered in Guernsey as well - you could check the airline's obligations with the Director of Civil Aviation (http://www.gov.gg/dca). If on the other hand they're UK based, then you would be covered. Maybe a call to the CAA to see if they're registered with them, and if that's enough to be classed as UK (and therefore EU) based?0
