Is it worth trying to claim ?

My flight back to the UK from Girona Spain into Gatwick airport on Sept 03 this year was delayed due to the plane we were to board was grounded because of a hurricane on Cape Verde Island ...

We were due to fly at 00.45 to arrive in gatwick at 1.50, we didnt take off until 5 am and arrived at Gatwick at 7 am.........Do anyone think its worth me doing a claim , and also someone told me that on MSE there is a template to do it on , any help would be much appreciated ...Thanks Sheila

    The weather is outside of the control of the airline.

  • I haven't issue with people claiming for things that are legitimately the fault of the airline, but I do with things such as delays caused by weather. I also think that the claim amounts are too high in most cases.

    I say this because the airlines will not loose out (because they would just go bust), they simply have to put their prices up... so some people may think that they are 'winning', but really we will all loose out eventually. I know my flight to Greece has gone up by just over 15% for the exact same flight from this year to next. I can't see how this not caused by the claims.

    Now. I am not putting my frustration down to anyone in particular, but more at the 'claim culture' we now have. I strongly believe that if the airline screws up you should get something - but certainly not for so many of the things that are being claimed for.

    I was delayed recently and would have been due several hundred pounds from easyjet. I agreed with them to only take the cost of the taxi from the airport to my home. I done this because they provided a meal voucher which covered that cost, and the delay was due to an earlier technical fault. It was an annoying delay - yes. But was certainly not worth hundreds.

    So, I apologise if I was curt but I do have strong feelings. I would also be annoyed if you got a payout for this.

    This case was "legitimately the fault of the airline" since they did not have any kind of backup to protect passengers within Europe from the consequences of a storm hundreds of miles away in Africa.

    The amounts of compensation are set out in the law, and are intended to be a deterrent: the expectation is that airlines will take all reasonable steps to prevent delays and cancellations in order to avoid having to make these payments.

    Can I respectfully suggest you carry out research into the effect 261/2004 payments have increased flight costs. You may wish to start your research by examining the year end report and accounts for Jet2.com (Dart) where they project increased costs of 50p per flight per passenger as a result of having to pay delay claims. Personally I think a 50p 'insurance cover' is a well worth 'add-on' just in case I'm delayed over 3 hours.
  • Hi, new on here, and just trying to figure if we have a legitimate claim?
    Flew to Ibiza with Jet2 and there was a delay out of Manchester due to a problem with the auxillary power to the plane, so we sat on the plane for an hour before taking off, landed in Ibiza an hour late, only to eventually discover that due to the power fault, they couldn't get the hold door open to offload the luggage, we eventually managed to leave the airport 3.5 hours later than our scheduled arrival time.
    Do we have a case?

    the delay is calculated to the time the doors are opened to allow the passengers to disembark not to when you leave the airport (had you arrived on time it may well have still been an hour+ to leave)
    Given Jet2 have a reputation for not willingly paying out for valid claims I doubt that there would be a case here.
