Debit Card Scam

Hi - Im after some help. After being so careful of scams and phishing emails etc, it seems I have become victim of one. I had an email from Justeat.co.uk asking me to complete a survey etc. It took me onto a website which looked totally genuine and even had the padlock security sign (I always check this as a matter of course). It also had my card details displayed. It asked me to verify card as I had moved address. Stupidly now (I realise) I innocently put the details in. Next day a total of £770 has been taken out of bank account - it wasn't stopped by my bank and let through - all four transactions from somewhere in France. A pain as a genuine payment by me to a company only last week was stopped by the banks fraud team. Anyway, I have sought advice and a lawyer friend seems to think I will get my money back as I was not grossly negligent. I am worried sick over this and there is so much conflicting advice that I do no know where to turn - please help x

    You don't know where to turn?

    Turn to your bank and ask them for your money back.

    I don't know whether a chargeback would work as it appears you may have freely given this money away, but read MSE's article on Chargeback anyway.

    Have you told your bank that those payments were not authorised/were fraudulent? What have they said?

  • Yes I told the bank and stopped my card. The payments are still 'pending' so they cannot do something until they are taken. I have not given the money freely though - this is fraud surely? Just wondering what the chances of me getting the money back once it goes to the banks investigation?

    Am just confused as have sought legal advice and they have said I stand a good chance of getting my money back?
  • Yes told bank as soon as I knew but they cannot do anything until the money has been taken - apparently it hasn't yet
  • As I didn't authorise any payment to leave my account then is this still covered?

    With debit cards, you're reliant on the chargeback provided by visa/mastercard.

    There are chargeback codes for unauthorised transactions - theres also one on mastercard i think for fraudulent transactions.

    Its likely going to come down to whether these are viewed as authorised or not - giving your card details doesnt necessarily mean you have authorised any/all of the transactions. I mean you can give your card details for an order of £20, 2 months later the company could take a payment of £500 that wasn't authorised iyswim?

    Perhaps have a look at the financial ombudsman case studies and see if any of them are similar to your own circumstances.

  • Thanks for your help. I have had so many varying replies online that Im really not sure whether I'll get the money back or not :(

    And I'm really not sure what else you were expecting from an internet forum.

    I'm not trying to be clever, but only your bank can carry out an in depth investigation and decide whether or not you are going to get your money back.

    For example, you you have told us that you had no idea that this money was going to be taken from your account - and let me say now... I have no reason to disbelieve you. Your bank however, will want to be quite certain that you are telling the truth before they refund you.

    Wait patiently for a response from your bank.
