Housing Benefit Question

have been in receipt of HB for many years along with ESA and higher rate DLA. Have had a letter today asking for details of my adult children's earnings. I have not been asked this previously as it is disregarded as l get higher DLA. My children do not discuss their earnings with me is it mandatory that l supply this information , what action could they take if my children refuse to give me this information - thank you

    was in the same position a year or so ago.
    I called HB and reminded them about the DLA claim and that there is NO non dependant deductions.
    They agreed and I didn't have to send them any info.

    If you refuse to give details they will amend the non deps wages to £999.99 per week to trigger the maximum non dep deductions - but in your case your non deps income is irrelevant as you get DLA Care so no non dep deductions will apply.

    It could be that they are trying to verify that you still have non deps in your household to see if you are still getting the correct amount of HB.

    You don't have to supply details of your non deps income. There is nothing in the legislation to compel you to provide these details. Normally though it is beneficial for the correct details to be provided so the correct non dep deduction is taken.
    These are my own views and you should seek advice from your local Benefits Department or CAB.
