Second letter from Miah Solicitors arrived yesterday exactly the same as the one last week except new issue date.
They are persistent, I replied to the first one by email do I need to reply to this one and would postal be better.
They seem to still be calling it a parking charge.0 -
I asked a similar question on this board and was advised to ignore Miah Solicitors.
I was told that they would not take this to court as they would not win.
If this is the wrong advice and I should reply using Gan' letter from Pepipoo can someone confirm??

If it is better to answer them then I will - although I think the down side to this is they will keep chasing the claim rather than throw away but happy to take advise from anyone who has experience either way0 -
I certainly think they'd be wary of the £150 thing raising it's head in either a court or in a complaint to the SRA. Showing you are quite prepared to call their bluff over it might mark you out as one to give up on.Je Suis Cecil.0

I have emailed them asking to state if this is a) a charge for parking or b) a charge for breach of contract for not displaying the parking permit.0 -
Its supposedly a charge for advising their clients, but given that this is a template letter that gets sent to everyone, they cannot possibly charge their clients £150 over and over for the same advice/letter every time.

Reply to everything from TMS. The longer the paper trail, the more they duck your questions, the more likely they are to be sanctioned by the SRA. They are behaving in a very unsolicitory fashion.
Also, the more you make them work, the more they can bill their client.You never know how far you can go until you go too far.0 -

I'm in the same scenario, using my dad's car to move house in May 2013. We ignored the letters at the time and this week received the same letter as you did from Miah's.
If my dad denies he was the driver (although he is the registered keeper) can they continue to chase him?0 -
They 'can' do what they like as they are unregulated and the IPC won't stop them sending chaser letters. Read Pranky's Blog linked on this thread to discover how rotten the IPC's so called appeals IAS is...allegedly:

But your Dad 'can' just ignore them or respond as above. Come back if he gets actual court papers or a 'Notice of Legal/Court Action' from UKCPS or Miah. A letter with this idle threat (below) in it, is just 'debt recovery' (nothing) stage from Miah, not a Letter before Court Claim:''It says "we will take our clients instructions regarding how they wish to proceed which may include considering legal proceedings.''
Any case close to Court should be argued to be stayed for Beavis* anyway so now is NOT a time to waver and not a time to pay one.

Miah do go on to issue claims. Naming the driver wont stop them. UKCPS are bottom feeders who routinely ignore letters from motorists. Miah are bottom feeders off the bottom feeders. You need to reply to the letter before claim according to practice directions, and bring up the matter that charging £150 for 1 debt collection letter is against the solicitors code of practice.
You also note that Miah have admitted in the past this fee is not actually incurred.Dedicated to driving up standards in parking0
