Vodafone in breach of contract?

Hi. I'm half way through a 24mth contract and my smart phone has developed a fault and won't charge. After contacting Vodafone they said they would send me an envelope to send it off, but it never came. On re contacting them they said it was the battery and they would send me a new one. 8 weeks later and I'm still waiting. They've been sending me texts saying they are waiting for supplies from the distributor (in the mean time u bought a cheap handset to be able to make calls). These texts have now stopped.

I contacted them again via online chat to complain and they refunded my last monthly payment. I've head nothing since.

As far as I can see they are in breach of contract. Although I am able to use the sim in another handset (bog standard £10) I can't use data, Internet, no camera etc.

Any advice ?

    Which phone is it, how much would a new battery cost?

    IIRC, Vodafone do offer their own warranty on the top of their obligations under SoGA.
    However, firstly, I don't think that this warranty is a part of the contract and, secondly, I am yet to see a warranty covering a battery for longer that a year.

    Well they've confirmed it is covered by warranty. And even if the battery wasn't covered we don't actually know for definite that it would is the battery that is the problem.

    If its a removable battery then i would source one from Amazon and see if that cures the problem .

    why not source one, and send a copy bill. But as others have said im very surprised the battery is ever been covered
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    I had a Galaxy S4 with a dodgy swelling battery, they refunded me the cost of a battery as they had none in stock.

    I managed to pick one up for half of what they gave me. I had my doubts as to it being a genuine one but its still working well 20? months later.
