You won't win an eBay case as there is "proof" it was delivered. Well you might get lucky and get a non fault refund, but that's not guaranteed.
You can chase UPS as their contract isn't with you, it's with the seller. Your best bet is to speak nicely with the seller (perhaps give them a call?) and ask them to chase this with them.0 -
how did you get on? ive got very similar, ordered from ebay, come home to find a ups card on floor saying in wheely bin!! they put a parcel in my sodding bin, guess what, nothing in bin.
im not even sure what it is yet as bought a few things from ebay waiting for sellers to confirm0 -

I had a parcel delivered to me by RM, left in my porch. It wasn't for me wrong name, wrong house number right street, right post code. I rang RM and they said tough they had delivered it to the best address possible and if I didn't want it I could drive 7 miles to return it to them!
I slung it in my garage. 2 weeks later at 7am on a Saturday morning RM turn up with the irate intended recipient demanding their parcel. He wasn't amused when he found out I had told RM it wasn't mine and they refused to collect.~Laugh and the world laughs with you, weep and you weep alone.~:)

I have had these three times where tracking says delivered but buyer claims non delivery. The first two times the buyer sorted it out via messages and both times it turned out it was delivered, someone had taken it in for safety and not told them. The third time I tried to help the buyer and after a few days they opened a case. I now have a possible defect. So I let Ebay sort it out. They found in my favour and removed the defect.0

Your situation is very different. Being carded does not constitute a delivery. The legal standpoint is that it should be delivered to your hands and signed for.
If you have a card it basically means the courier couldnt be bothered to complete the delivery so dumped the item. In Short if its not delivered to your hand and signed for then legally it has NOT been delivered.0 -

Not according to Ebay who will side with a seller when tracking shows it was delivered to a safe place.0 -
My question is not really going to help anybody, but I'm just wondering, do you guys not lock your porches when you're out, that the courier can deliver there?0
