to make things simple, you really need to ensure that he has no links to the property in regards to residing there, or you may be suspected of co habitant.

Yeah i'm currently in the process of getting the Electricity, Gas and Virgin switched over to my name, not sure about the Electoral roll will have to E-mail him about that.
Can i ask what you mean by suspected of Co-Habitation? As in a couple?0 -
if he has a financial tie 9 other than a BTL mortgage) at your address, then the cross chcking will highlight this.
if he has utilities coming to this address then they will obviously ask where he lives0 -
Even if your 'landlord' works away, his principal place of residence will still be his home. Putting the utilities into your name just means that you have taken responsibility for dealing with them.
If he has a mortgage, he needs to notify the lender that he is not resident.
His Insurance company will also need to be advised he has a tenant/lodger.
If he's renting the entire property to you, he has obligations as a Landlord that he can't just ignore.
To claim HB you will require a tenancy agreement.0 -

I already went through all this i thought, i applied and the Housing Executive phoned myself and the house owner for more info.
I explained the situation which they seemed satisfied with, and they sent me a letter saying i had been awarded HB and sent me my first payment yesterday.
Why would they do this sort of checking after the fact?0 -

they randomly cross check claims using data matching.
if you landlord is still using the address as they ' main residence' then it will flag up a query on your claim * leading to benefit being suspended).
also if the landlord hasn't told his mortgage provider that he is renting the property out, it could lead to insurance being void, leaving you in a very bulberable position.0 -

yjr cpndequences affect you too. of you need to make an insurance claim for instance.
for benefits purposes, a tenancy has to be legal and not just someone renting their house while they are away at work.0 -
It occurs after the fact as they are getting quite a lot of stick for delaying benefit payments for no good reason so they pay you so you can pay your rent then continue following up on minor details later and if they find an overpayment they'll ask for it back.Sorry when will this cross checking occur?

You don't need a tenancy agreement to rent a room so that maybe why they haven't required that at this stage as you're only entitled to the room rate anyway. You do need a tenancy agreement to rent the whole house so you'll have to get one of them if you are.:footie:

So since yesterday morning when you...'received a letter this morning informing me i am only entitled to and have been awarded £52pw which i believe is the shared accommodation rate , so obviously i wasn't expecting my award to be this low....
Is that the amount you received ?I'm wondering if i have misunderstood the rates and what i was likely to be entitled to....
