Excel parking PCN

Hi, I was issued a PCN on Sunday for my car not being parked correctly and now wondering what to do as they are asking for £100 The reason my car was parked as it was. Is due to on arrival at car park there was a car at each side of the space and I parked in between them and to leave enough space for myself/ passenger to exit. My front tyre being half on the parking line and half over. Also my wing mirrors were folded inwards as to not take up an extra space. My parking was in no way hampering and other parking space as the car on my near side was there when I arrived and was still parked in same place when I left. The vehicle on my near side had gone and was replaced by another. I do have pics but not sure how to attach?
If anone could please advise what is best to do as this is my first time lol

Please read the NEWBIES FAQ sticky at the top of the forum threads' list, one page back from here, use the Forum Jump button to navigate there. It contains most of the information you need; written by Coupon-mad, one of the most knowledgable people in the country on private parking charges. It is the most comprehensive resource available online.
You do need to read and understand that sticky as you will have to do a bit of work to deal with your problem. We will help and guide you, but won't be able to do it for you, so the more knowledge you gain about how to deal with this, the better you will handle it, and the more likely you will be successful.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

"what happened " on the day is not relevant here
the fact is that they have found you "breaking their rules" and have issued a speculative invoice which they have 6 years to try to enforce
so now they have you dangling on their hook and you will have to try and wriggle free , achieved by the following
an appeal to the PPC which may get the invoice cancelled (unlikely but try it using the template letter when it is the correct time to do so)
an appeal to the IAS (part of the IPC appeals system) which is again unlikely to get it cancelled (its a kangaroo court) - note , POPLA is not an option here as they are no longer using the BPA methods for appeals
a complaint to the landowner to get it cancelled (your best option)
if we assume you decline to pay this speculative invoice, then its 6 years of ignoring the harassment by letters, only dealing with an official LBC or official MCOL (court papers) from Excel themselves
hopefully this will teach you the details surroundings these sc@ms and that you will refrain from giving them these golden oppurtunities to make your life a misery for up to 6 years (in england and wales)

ask any retailers or occupiers of buildings on the site , google or lastly the LAND REGISTRY0

It used to be a car showroom and now no one is using the site now just for parking. I have read the Newbies section and blowen my mind. Now thinking prob best to pay the 60 pounds if pay with in 14 days. Then face the fact got riped off.0

whilst I dont agree with paying these parking scumpanies extortionate fees, if you dont have the permission of the landowner to park on his land you really should not be parking there
I would not pay as there could be many legal reasons why no monies are owed, but the choice is yours, either way, make sure you have the right to park on land before doing so or you will get more of these invoices0 -
Thanks redx It is a car park now with ticket machine and i did buy a ticket to park there. I phoned the dealership that used it and they moved from there 10 years ago but have no idea who owns the land. Think going to be a hard one. Trust me I don't wish to pay at all why should I give a bunch of gits my hard earned money.
Just its a case of pay 60 or 100 now compared to court cost if I lose. Wish I knew how to attach pics you could then give me a honest view if I have a case or just take the hit0 -
if you bought a ticket then the landowner has suffered no loss and that would be part of your court defence, especially if you still have the ticket (its your contractual invoice) - you didnt mention any of this in post #1 , yet its extremely relevant to the case
you cannot attach pics here, you host them on a site like tinypic or photobucket and then post a dead link to them, changing the url from http to hxxp
any pcn, especially an NTK (a postal invoice) should contain details of the creditor, which could be the landowner, the land registry will tell you who owns the land0 -
Thanks the ticket I had left on winderscreen only listed EXCEL parking services and a site number. So will have to see what can dig out. Will try to add pics later0

the whole scam is set up in such a way as to make you feel like that ...:(
in fact when the debt crawlers letters start to appear you may feel even worse :eek:
If the good forum members now started to ask you for a contribution for the advice you have received ...... you would be horrified / annoyed :mad:
even if we started to 'fine' you for non payment in
red text
you would recognize that we where trying it on
parking scams are in essence the same .....
keep up your fight, follow the information given above (there are several well informed posters on this forum who will help)
