Fraudulent Default on credit report

    This is not a viable solution - otherwise everyone could buy their way out of factual defaults and the OP appears to be belligerently refusing to supply enough information to the Data Controller to allow them to positively identify this correctly.

    I am sure the DPAs hear this kind of argument every day with a very tiny fraction of them actually being true so they follow the due course.

    ICO will have no interest in this until the time has been allowed for an internal investigation. Police will also do nothing at all and Action Fraud will also only collect it for statistical purposes as they won't generally look at a stand alone case.

    A better outcome is surely to be achieved by changing tack and being as co-operative as possible at this stage and then pursuing compensation at a later stage rather than cutting your own nose of to spite your face etc.

    A default can only be issued once. If you had a default registered on your account in 2011 then it would have been updated monthly since then.

    Have you obtained copies of your credit report from Equifax and Call Credit too to see if the default shows on them also?

    The main question that needs answering is – did you take out a loan with HSBC in the past?

  • Hi, It's not my loan, I don't know where it is from...

    They so far have no paperwork to show my name on it, If they do find anything then someone has stolen my identity to take out the loan...

    I would prefer a setup where if someone wants to publish defaults on your credit report they have to show a copy of the Credit Agreement and Default notification before it goes on... rather than them putting it on with no evidence and then refusing to remove it until they have tried every avenue possible to link it to me...

    I have provided them with all the details they need to investigate this, however, now they have this information they will no doubt just amend the default and records to align with my residencies.

    Court seems like the only option unless someone can think of something else?

    Can you answer the other questions please regarding whether this default is showing on your other credit files and also what the actual date of the default is.

    If the loan is not yours and has nothing to do with you, all you can do now is wait until Experian remove the default and then take them and Idem to court to sue for losses. Make sure you have kept copies of everything because this would be a high compensation amount if what you are saying is correct and they have just applied a default to your credit file which has no association to you.

  • Hi, the default date is 31/10/2011, I haven't checked the other credit reference companies yet, most security and background checks for my line of work only go through Experian, I'll check though...

    I must admit - the guilty until proven innocent is a !!!!py way for the system to operate and placing the burden of proof on the creditor before adverse information is posted does sound like pretty sound common sense.

    If the default was registered in 2011 and you work in the financial sector and have managed to not have it affect your work/contracts before, why is it affecting it now all of a sudden?

    The more aggressive and evasive people are. The less likely one is going to believe them. Or in fact help them for that matter. To resolve matters, whatever the outcome, requires co-operation.
