Re: Armtrac PCN. Proprietor claiming they can't help

Hi everybody

I received a PCN from the lovely company that is Armtrac on the weekend. This happened when my car was parked in a pub car park in Truro over night, got the ticket the next morning.

First thing I did was email the pub and ask them to get Armtrac to cancel the PCN. They have replied saying that they are powerless to do so. Can anybody advise on whether this is true?

Thanks for your help

Tom

It might have been a tenanted pub and you need to get hold of the owners.
Do a search, the landowners can and do cancel and this is often the best first stage in the appeal process.

  • If they employed these pests then they most certainly can cancel.

It is essential that you follow this advice. The sticky thread will explain everything you need to know. Concentrate on post #1 at this stage (with reference to post #2 for acronym explanation).

Thank you all for your replies. I had already read the newbies post, just wanted some clarification on whether there any circumstances in which the landowner would be unable to get the PCN cancelled.

The pub mentioned in their email that they 'do not profit' from the arrangement.
  • If the pub/hotel doesn't wish to reflect on its position an entry on the Facebook or TripAdvisor page may be helpful in making them have a rethink.

that's a handy statement , so the parking Co keep the money , there only form of income is the money gleened from you?

what has the pub lost ? nothing , so the owner has no loss , then why allow a company to "fine" (I know)

I put it that there has been no loss to the landowner.

on my fist letter to the PPC , I would be asking for sight of the contract , at least enough to see who signed it , and in what authority
  • That's a good point Freddie, I'll bear that in mind for if it gets to appeal stage.

The pub have emailed me back again to say that they will ring armtrac and try to get it cancelled. Even if they aren't successful, would evidence of the landowner being against the fine be useful to me for my appeal?

yes , the land owner hires them , just like his chef or barman , as the hirer he can "TELL" them , not ask them to cancel the charge.

the PPC would look foolish if they went to court , and they were working for the landlord , but acting against his wishes.

if the guy comes back and says "no go" , remind him that the next ticket he might be paying , may well be one of his visiting family members.

Apparently Armtrac have offered to halve the [STRIKE]fine[/STRIKE] speculative invoice--very generous of them! Clearly even they believe that the amount they put on the PCN is exorbitant.

I'm not sure how to approach the issue with the landlord now as they seem under the impression that it is entirely Armtrac's decision as to whether the charge should be cancelled. Any suggestions?
  • then the landlord is wrong , the fact that he contacted amtrac to ask for it to be cancelled proves that he is not happy.

amtrac are failing to act on behalf of the land owner.

save any emails from the landlord and tell amtrac to ^&*% off
