  • Debenhams weren't interested. Said it wasn't their car park basically. Going to write to them separately if they don't cancel the ticket.

    Just remember that the POFA out of time only applies to the Keeper - not the driver, so don't blunder by writing anything that couls identify the driver in any appeal.

    You simply need an appeal saying" Your NtK was sent to the Keeper out of the stipulated 14 day period. The keeper was not driving and, therefore, keeper liability is no applicable. Furthermore, the keeper declines to name the driver.

    Please cancel this invalid NtK and confirm
    ."

    However, it all depends upon what you have written or plan to write to Debenhams and if you have given away who was driving, then assume that Debenhams might send your letter on to the PPC asking if they might cancel.

    I was going to wait for the response before contacting Debenhams to avoid any keeper/driver issue....

    Write to Debenebenhams anyway, just don't use phrases like "I", "we" or "my partner" etc, but only use "the driver" whom you're obviously under no legal obligation to name, nor are you going to ;)

    Here's what I just sent to all 5 of the retailers on the site the drivers of my partner's vehicle (see what I did there?) got pinged at.

    PARKING CHARGE NOTICE XXXX INCURRED WHILST SHOPPING AT YOUR OUTLET – DD MMM 2015

    I wish to complain in the strongest terms possible about a parking charge notice I received whilst visiting your retail outlet on the subject date. It is alleged by ParkingEye, who manage the parking on site, that I overstayed the 3 hour limit imposed by them. The camera system in use has failed to register two separate visits of the same vehicle by different drivers visiting different outlets during the day and instead generated the parking charge notice based upon the first entry time and second exit time.

    I initially appealed to ParkingEye who have turned down my appeal and referred me to the Parking on Private Land Appeals service (POPLA) whose process I am currently in the process of initiating but would like to give you this opportunity to see if there is anything that you as the manager of one of the outlets are able to do before it goes any further. As a frequent visitor to your establishment, I would look to you to get the parking charge cancelled by ParkingEye.

    If you are unable to deal with this matter yourself, I respectfully request that you refer me to somebody that can. Perhaps the owner or manager of the land?

    I am aware there have been complaints in the past associated with ParkingEye at this site. Public outcry (apparently backed by some of the retailers on the retail park?) caused the time limit to be raised from two to three hours. There are a couple of articles available to view on the Grantham Journal website detailing this saga. I have also been in touch with the Grantham Journal to highlight my case and raise concerns I have over ParkingEye ’s seemingly indiscriminate and bully boy approach to parking management and indeed their whole business practices.

    Your assistance in this matter is greatly appreciated.

    Something along those lines, obviously tailored to your circumstances and changed so it isn't aimed at ParkingEye should have some mileage.

    Don't be shy at coming forward, it's not like they're friends you're worried about upsetting!

    When they were spoken to no details were given whatsoever. Now Im paranoid about this thread being checked re keeper/driver etc!!!

    Edit your OP so it reads "The driver also had to pull over in the car park prior to exiting from memory. The driver had obviously paid for the car park" and you're golden in that respect. (Anybody else spot anything I missed?)

    Hah! Lady in the PO gave me a funny look as her little printer churned out a load of proof of postage certificates for the pile I posted off this morning!

  • Thanks for all your help, sent it via email and no failure notification has been received....such a nuisance all this. What really gets to me is that they know when sending these out whether or not it is compliant. Mine wasn't so DONT FLIPPING SEND IT!!!
