Newbie with Parking Charge Ticket in Disabled Bay at UKPC
Comments
-
Back to the OP....Dear Team,
I have tried to understand the Newbie Thread for Parking but would still kindly appreciate some specific advice. I parked in a disabled bay for a few minutes to pick something up, I do not have a blue badge and there were lots of disabled spaces available. The parking charge was issued in a UKPC car park and the bay was clearly marked as disabled, so appreciate its my mistake is there anything I can do to mitigate the cost of the charge? Should I raise my challenge with UKPC or POPLA reg loss of earnings brought upon by my parking ? I am aware that there has been some changes to the Keeper of the vehicle being liable to charges since 2013 when the Newbie thread was created.
Thank you in advance for your help.
In my opinion, you should never deliberately park in a disabled bay in a private car park without having a real need for it, however from your above opening post you state you made a mistake.
This type of action may deprive a disabled person of a space, and/or also gives the PPC's an Excuse to exist so they can carry on harassing disabled and able bodied drivers alike.
On the flip side of that you have a private entity demanding you pay them £100 that will go straight to them, and contribute towards their profits/owners yacht etc and further fuel their greed, paying these shysters is also, in my opinion completely unacceptable.
My advice would be to fight it as per the advice given in the newbies thread, keep it dry and free from any mitigating circumstances ( such as the why and how ) you can admit to the parking scum that you parked there by mistake in order to get a popla code.
Once you have successfully challenged this then why not either make a small donation to something like a community transport group that typically provides transport for disabled/elderly people, or volunteer your services in some way and give up a little bit of your time to help others - even if its an hour a month or a one off helping with an event ( such as charity fundraiser ) any help would be greatly appreciated. From the Plain Language Commission:

I am a BB holder and have no problem with someone temporarily waiting in a disabled bay to collect someone, especially if there are lots of other disabled bays available. I cannot understand this faux outrage. You never know how far you can go until you go too far.0

if you get a TXT from UKPC asking if you would like a new "smartphone" please refuse it!

Hi,
I am new to this forum and my case is similar to NasK except the driver who parked was different from the registered keeper. I am the RK. I am looking for a template to appeal to POPLA, read through a few forums including "newbies" but can't find an appeals template.
I have gone past the first stage of appealing to the parking company who responded with a POPLA reference. The deadline for a POPLA appeal is Friday 04th Sep15.
Would also be grateful if someone can point me to information (including templates) on the NTK rule. I haven't yet received a NTK and its been more than 56days since the initial windscreen parking ticket was issued
I apologise if this is 'hijacking' his thread and will start a new one if you prefer. Only reason I posted was because I see a few 'knowledgeable' people are already following this thread.
Thanks.0 -
You need to:
1/ Start your own thread. (We work on the basis of one person, one thread, to avoid confusion)
2/ Register your intent to appeal with POPLA. You can't actually appeal because POPLA is changing to Ombudsman Services,0 -
Thanks. Have started a new thread :
On that please can you elaborate on your second point.0 -
In fairness, keepitlegal was reponding to a question I asked earlier, so I am the one who was guilty, if at all, of hijacking the thread.
However, there are a few contributors with mobility issues, some with and others without BBs, and as they are the ones who may be the most inconvenienced by people without EA conditions using Disabled spaces, their take on the matter is welcome, I would have thought.
NasK appears to be an able bodied driver who had no "right" to park in a disabled space, even for a few minutes and is asking for team help to avoid the £100 charge. Because of the sum, we gladly help, but I know of a couple of my mates who have BBs and have not been able to use wider spaces provided because able bodied motorists have got there first. When it becomes personal involving friends, I admit having the sentiment s of "Fine the bas****s".
So I now confess to being a hijacking hypocrite.:o:o
