Re mortgage payments, if his name is on the mortgage and it falls into arrears then it will affect his credit worthiness. He needs to have a good chat with that mum as they could agree to sell the property and split equity. equally, she could get a order to remain in the property until the child is 18.
Maybe I am wrong, but even if such an order was sought and obtained I can't see a court ordering him to pay the mortgage. She may well have the right to live there, but she also has the equal responsibility of paying the mortgage. If the mortgage fell into default, yes of course it would affect their credit worthiness. Sorry, but I wouldn't be paying the mortgage or even half of it if I wasn't living there.
Selling up is the only way forward as I see it. If she wants to live there then she should buy him out and take on a new mortgage in her name only.0 -
I didn't say a court could order him to pay it, I said that his ex could seek a order to stay in the home. Its not always as simple as just selling up and moving on for various reasons.0
