Solicitor wants proof we can pay them the fees

    But it's not due yet? Nobody has told us we have to pay it or when it has to be paid. Why am I going to throw money away if the mortgage didn't get approved?
    Like I say the guy was fine with it but obviously hasn't passed it on

    Kinger whether I choose to spread the cost is not upto you it's upto me.
    Funny how on a money saving forum you are advising I pay out money when there's no guarantee il get a mortgage and lose it. Good advice.
    This is why we haven't proceeded far with the solicitors as if the mortgage got denied then it's money down the drain.
    Please don't reply with it's part of the process as losing money for nothing is not something I'm willing to do just like that. Anyway our mortgage has been approved so il update you when we our in our house we CANT afford.

    You said in your original post that you've been asked to pay the search fees, but "refused".

    Because the solicitors have commissioned the searches. They now wait for them to come back, then they go through the results to see if there's things you need to be aware of. When those searches are commissioned, they need to be paid for.

    If you haven't told the solicitor to hold back on them, then commissioning them is one of the first things they do, because of the delay in getting them back.

    The solicitor would refund the any unused fees if they had not yet started the searches, which they wouldn't have done because you instructed them not to.

    Well obviously that's been the issue but like I say we've got our mortgage now and the money is in the bank. When I said we were short I didnt mean the whole amount and we could afford the search fees no problem, we just wanted to hold off as long as we could without spending further for nothing.
    Not a crime really is it.

    Refusing was probably the wrong word. We just wanted to wait and they seemed fine with it. Our mortgage offer has taken nearly a month though so maybe that's why they were getting worried as we hadn't got back to them

    No, refusing to pay legitimate debts is not a criminal offence.

    I bet they haven't if the op has yet to put the solicitor in funds to cover the cost of searches.

    Good luck with that. I hope you realize the vendors are well within you're rights to sell to someone else before exchange of contracts. They may well do they if they perceive there are constant delays on your side on the conveyancing process.

    I'm not sure why you even posted this. If the mortgage has now been approved, stop messing around any pay up.
