Vodafone in breach of contract or not?

This might be long winded but please bear with me....

I had a Vodafone contract paying around £48 per month. Around 6 months ago I upgraded my phone and had to change my contract which went up to £58.50 per month. My new contract included unlimited minutes, texts and 10 GB of data and included NOWTV for 24 months. With my new contract I was put into the data test drive for 3 months. At the end of this 3 months my data averaged around 20GB per month, so I called Vodafone and a helpful man their said not a problem sir I will put you back onto the data test drive for an additional 3 months. So I got to 6 months down the line (last week) and called Fodafone again and said I need to increase my data on my contract to at least 20GB as this is what I have been using on average on the data test drive. Vodafone customer service said ok no problem I can do you a deal which is the same minutes and texts but 20GB of data for £65 per month. Fine I thought a little increase for double my data which seemed fair. That evening I noticed that my NOWTV package had stopped working so decided I must call them which I did today which took 3 hours of phone calls and being hung up on. Customer service told me I could not have NOWTV as part of my current contract and would have to increase my contract to £70 per month. At this point I was getting peeved!

Now after more calls and being hung up on I got through to a mother person who said I could have my old contract with 25GB of data for £65 per month and get my NOWTV back so I agreed and he hung up the phone abruptly. I check on my Vodafone app and he has signed me up to a £69.99 contract and also kindly added £4.02 of additional charges onto my account which I cannot find out what they are for as I am in work right now.

So far Vodafone has miss sold me a £65 contract last week and now today agreed a different £65 contract with me and started to charge me £69.99 for it with some strange additional charge. I am sick of Vodafone and am going to cancel me direct debit in the morning then call Vodafone customer service to cancel my contract which I feel they are in breach of.

I know this is long and it could have been even longer if I noted everything which went on in a 3 hour telephone marathon.

Can anyone advice if Vodafone is indeed in breach of contract or not?

    I see some error, and don't see any breach.
    Their CS is inept, but this doesn't come as a surprise to anybody and isn't a breach of the contract.

    £69.99+£4.02, if correct, doesn't seem to be a very unreasonable price for 25Gb compared to the original £58.50 you agreed to pay for £10Gb. "If" because it's still unclear what £4.02 is.

    Good luck with cancelling the DD - if you don't give a !!!! about your credit history.

    Hopefully you don't want to buy anything on credit or get a mortgage in the next 6 or so years. Vodafone will trash your credit file and send you to the debt collectors without a second thought.

    I'm pretty sure the NowTV/Spotify add-ons are only free for 6 months anyway.

    Seems like a price esculator. £60 for one mobile phone contract, honestly that's expensive. I refuse to pay more than £30-35 per month.

    Surely you need to downgrade back to the original contract price and just use WiFi of vf''s inclusive WiFi?

    20gb per month seems high and means your Spotify is constantly downloading. Use deezer myself which is free minus data with ee. It has a smart cache feature which saves the most played sounds in the phones memory (temporarily about 30 songs).

    I'm on my phone all the time literally and only use 4gb.

    I'd revert back and consider changing your usage habits a bit or apps you use. I'm one for efficency not just using data needlessly.

    Indeed. Sometimes one can argue that the supplier breached the term of the contract that states that "the supplier will carry out the service with reasonable care and skill". Every contract for the supply of a service has this implied term according to Section 13 of the Supply of Goods and Services Act 1982. But in this case, I think it would be a fairly weak argument.
