    This is the reply I've had (Dated 17/09/15)

    "We are not pursuing you as the registered keeper of the vehicle and, as such, the Protection of Freedoms Act does not apply in this case.

    If you believe you have any relevant grounds for appeal, please forward these to us so that we may give them consideration.

    We can confirm that we will hold the charge at the current rate of £100 for a further 14 days from the date of this correspondence"

    Dear CP Plus,

    Thanks for your letter. As the driver is responsible for this fine, please take the matter up with them. No further communication will be entered in to by our company on this matter.

    Please discontinue the practice of misusing the term 'fine'. As far as I have read, the police were not involved in this matter from the outset, so the term 'fine' is wholly inaccurate and misleading.

    Police can't 'fine' anyone. Only the court can issue a fine.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Police do issue on the spot fines


    And others not associated with 'the court "

    Fines for litter etc

    Fines for parking.

    Fines for no mot

    And state something like this to point the way ahead or you'll be playing email tennis with them for weeks:

    Our previous contact was the appeal from the company as keeper - i.e. our appeal is that, in law, the company cannot be held liable and your charge is not based upon any loss. If you wish to hold keepers liable might I suggest you read paragraph 9 of Schedule 4 of the POFA 2012 and change your wording accordingly. However, in this particular instance it will be too late for you to send us a compliant notice and we will not be naming the driver.

    Either accept or reject that appeal and send a POPLA code, or we will report your actions to the BPA.
