2-leg journey - can I claim?

Hi everyone,

I am new to this so apologies if my forum etiquette isn't up to scratch! I thought I'd sign up as I need some advice as to whether I have a valid claim for a flight delay if it is only one leg of my journey?

In 2012 I bought a ticket with Air Asia X to travel from Gatwick to Perth, Australia. The first leg of the journey was supposed to be Gatwick to Kuala Lumpur, then the next flight to Perth. To summarise a convoluted tale of various frustrations (including having to rearrange Perth transport arrangements from a UK mobile while in KL as I am sprinting through the airport), the Gatwick - KL flight was delayed by 10 hours but I still made it to Perth on time. Just.

Is this valid for a claim despite it being only the first leg of a journey?

Any advice is appreciated!

whether you can claim will depend on what the final destination of your ticket was as EU compensation is based on the delay at your final destination
If your ticket ended in KUL and then you had a separate booking from KUL-PER then you may have a claim (depending on reason for delay) based on your delayed arrival to KUL (final destination on ticket)
If your ticket ended in PER (which I think you imply it did) and you were not delayed over 3 hours arriving in PER then there is nothing to claim apart from possible reimbursement of expenses whilst waiting at Gatwick

The real problem is Air Asia X no longer flies to Europe at all and is very unlikely to be concerned about complying with the law even if it applies.

If you had a through ticket and arrived at your final destination on time, many would say there was no delay at all to be claimed but I am not sure I would even waste my time trying to deal with a Far Eastern company who knows you won't sue them if they ignore you, sorry
  • Thanks for the advice - sound like it could end up being a bit of a waste of time and a lot of effort with the company being based in Malaysia!
