UKCPS Notice to Keeper

After a bit of advice after checking the Newbies thread.
We have just returned from holiday to a Notice to Keeper letter from UKCPS. They are claiming that the keeper owes them £100 because they have ignored their 1st letter and the notice they put on the car windscreen.
We have never had the 1st letter nor the notice on the windscreen.
We (and our family and friends) use the car park daily, it is the only car park in our town centre and it is controlled by a ticket machine (free for 3 hours but a ticket still required) and a camera which records you leaving. In 5 years neither myself or my family and friends have ever seen anyone issuing tickets on windscreens (why would they when they record you leaving?).
The 3 hours was not outstayed but a ticket was not obtained either.
We are not going to pay them but want to appeal. The letter we have received says it is now too late to appeal, should we write them a letter of complaint about the fact that we have never had anything on the windscreen or the 1st letter?
Not sure what is the best course of action to take so any advice would be appreciated.
Looked for them on the BPA website and couldn't find them listed (even went to Companies House Website incase they are registered under a diff name).

If you read the newbies forum you will know that the first ticket shouldn't have been replied to.
You can now write to them without revealing the driver as advised in the FAQ0 -
Did the paperwork mention v.a.t.? If not UKCPS may have a problem.
They claim that their signs constitute a contractual charge, but parking fees attract vat, whereas liquidated damages for breach of contract are vat free. The problem they have with this is that they can only claim for their losses, which, in this case are nil. Further reading:

Ask them for a vat compliant invoice, if they decline you are entitled to suspect tax evasion

they are in the IPC , not the BPA (and have been for the last 12 months) , and they probably wont allow any appeals now no matter what you want
its wait it out for 6 years unless they try a court claim, which is always the case, because once you get trapped with an invoice then the small claims court is the ultimate end if the PPC wish to go that far
what you want is now irrelevant, you are playing the game whether you like it or not, you have been picked to play, and are playing, regardless0 -

I haven't relied to anything, like I said I never received a ticket OR a 1st letter. The first I knew of this was when the Too late to pay the reduced charge letter came.
Are you saying I can write to them (as the registered keeper) asking to appeal under exceptional circumstances because of the reasons I have stated above?

No mention of VAT on the letter.

You'll see (if you do a search) that you are getting the normal treatment from them.
The normal advice is now do nothing unless they take court action.
If you decide to write to them don't reveal the driver!0 -

However, if they did take it to court they would have a mountain to climb. First is the problem which they have with v.a.t., then there is the UTCCC Regulations, then the fact that no-one in their right mind would willingly agree to pay £100 to park without a ticket.
Then there is the problem (for them) that you are being forum assisted, which means that you are not going to be a pushover.
Do not forget to snitch on them if they fail to provide a vat compliant invoice.You never know how far you can go until you go too far.0 -
