She pleaded guilty and offered no mitigation or bothered to attend court . I think if you are honest you know the answer as to whether she can NOW do anything about it. The case is closed. Hopefully others will learn from her experienced shared on here.

She didn't plead guilty to speeding. It was failing to name the driver.

Doesn't matter what the fine and points are for. They are going to have no effect on her life other than they will both be more careful and the financial implication (fine and increased insurance).

As long as her and her partner split the cost, move on and learn from it.

They said they couldn't adjourn again but told her to plead guilty and then appeal.....
If the court actually sent her this ridiculous advice and she has kept it then she should seek legal advice on what to do.

Otherwise as others say, she should move on.

Thank you will get the exact details from her later. Because of the tome lapse she couldn't actually say who was driving.
I can understand this. There is no way I'd be able to say who was driving my car on a certain day 6 months ago.
Remember the saying: if it looks too good to be true it almost certainly is.

I think they could pretty much make a decent guess.

In which case you are possibly in line for a 6 point penalty - it's one of the responsibilities of being the registered keeper to know who's driving the car at any point in time. I'm pretty confident that I could work out who of the 4 drivers that can drive my car was using the car at any point in the last 12 months.

In these circumstances it can sometimes be helpful to request images of the car to help identify the driver.

People have lied before to get less points and been caught and given some time for it.

Sounds like she tried various outdated ways to get off a speeding ticket. Not being funny but most people know by time of day and location who was driving even in a shared car. People tend to have a habit of who drives various routes.

I don't think there is anyway she can get round this, if she had researched properly she would know the points would ultimately fall to her as the registered keeper.

Sounds like this is the end of the road on this one and an expensive learning experience for wasting other peoples time. If you share a car you need either to nominate or keep records. What if it was a more serious crime ? Sorry not sure who was driving at the time of the hit and run so please let me off ????

:rotfl:I'll put a logbook in the car and instruct my wife to sign it each time she drives: Time Entered Vehicle, Mileage out, Mileage in, Time left Vehicle, Signature, Print name. That should do it. :rotfl::rotfl::rotfl:

There would be the defence that you did not, and could not with reasonable diligence, name the driver.
    s.172, (4), Road Traffic Act 1988.

But they have pleaded guilty , end of the matter ? A defence is only of use if you don't plead guilty . Many people come unstuck with the "don't know who was driving" excuse when speeding tickets/nip's come through. Hence why the punishment is virtually double what would have happened if admitted the speeding offence.
