    That's to do with damage to property. So for example if Openreach did a botch job of an installation leading to a pipe being damage spraying water inside of a building and has literally nothing to do with e-mail. I'd love to see someone arguing in court how a bunch of ones and zeros interpreted by a CPU is a physical entity.
    The evidence you are looking for does not exist, you are compounding your loss by wasting goodness knows how much time in a hopeless cause, but if you really can't drop it take some paid for legal advise because you are unlikely to get any further here.

    Complete waste of time and money but you're right. The OP can take this to court and add court fees to the list of his losses!

    On your residential BT contract email is a non charged for free value added service so you are flogging a dead horse seeking compensation but you obviously think that you know best.

    Only an idiot would believe that a free ISP email account to be safe and secure for ever.

    From the oldest version of the BT Standard Residential Terms and Conditions that I can find on the Wayback Machine, is the clause:

    Unless the service terms say otherwise, we have no responsibility to pay you compensation for financial loss, for any information which is lost or corrupted, or for any loss that could not have been reasonably expected . We will not be liable to you for any losses that you may suffer if you have used the service or equipment we provide for business purposes.

    Don't rely on an organisation that tells you it takes no responsibility for any lost data to look after your valuable data.

    Realistically, the best you are going to get out of them is an apology.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
  • This thread is comedy gold. The OP is trying to claim some form of loss and compensation for "important" data stored on a free consumer webmail account! You seriously couldn't make this stuff up!!!
