You clearly have limited knowledge of contract law or the sale of goods act, it is a requirement that the supplier uses 'skill and care' which in this case BT failed to do, in the process of handling my complaint BT lied and changed 'DATA' which is also 'not recommended'.
There are also problems, in my opinion, with the OSC who have obligations as ADR administrators, i.e. 'passing off' and failing to comply with their own 'terms of reference'.
As a matter of interest have you ever dealt with the OSC or BT for 'customer services'.0 -

This has all gone before it was not a one off, 9 years emails under discussion, all mentioned in my original post and subsequent replies.
The issue is as per my original post, dates given.

What solution do you actually want?
The missing emails to be somehow recreated? A compensation payment? BT execs chucked in jail?
What will a successful outcome look like to you?0 -
Firstly I would like BT to recognise the loss they caused by their negligence.
Secondly the complaints procedure to be improved, relating to BT the OSC and the PHSO and at least follow the guideline published,
Thirdly compensation for my losses.
Finally Ofcom to recognise their responsibility as 'Competent Authority', this would prevent others going through what I have been put through to achieve the above.0 -
What do you consider to be suitable compensation for the loss of a domestic mail box contents ?0

Afraid you are tilting at windmills OP. If you were paying BT to provide secure backed up data storage you may of had a case, but you did not so you should have had your own back up in place and because you did not, the loss Is down to you.0

You failed to use "skill and care" by not taking the necessary steps to backup your data.

So presumably when you chose to terminate your agreement with BT, you knew that any data held in your email account would be deleted?For customers who cease Broadband service after 1 July 2013
14. If you have ceased your broadband service you will be able to continue to use your email account for a period of 30 days only, after which we will end your email account(s) or products without notice. This means any data held in the account will be deleted. If you wish to keep your email account you may do so by moving to the BT Premium Mail service before the 30 days has expired.0
