Hi All
I sent a letter to POPLA stating the car reg xxx was not parked at the location stated on that date and they rejected my claim. I sent a photo of the location stated on the ticket which did not match, but still no joy. They have now sent a letter asking me to pay within 14 days or risk bailiffs visits or court, what do people advise.

Are you saying that you appealed to UKPC, got a rejection and then appealed to PoPLA and lost?
It's very unusual and actually quite difficult to lose at PoPLA with a forum assisted appeal, especially against a company like UKPC.
PoPLA decisions are not binding on the motorist so there is no obligation for you to pay anything, especially not to UKPC who are being investigated for fraud for a third time at the moment. They were caught doctoring time stamps on photo's last time, so any pictures they rely on as evidence are automatically suspect. In fact anything they say is suspect.
Either they won't have any pictures of your car at all, or they will have pictures of your car in a different place to the stated on the NTK. It would either be "he said - she said in the first instance, or accidental discharge of a firearm into their pedestrian equipment. Quoting their fraudulent activity and temporary suspension by the DVLA would be enough to cast doubt on their statements so there is no way in my humble opinion they would want to go in front of a judge.

How did you manage to lose at POPLA against UKPC? No-one here does, did you not send a detailed POPLA appeal with several points?
If the latest letter is from debt collectors, ignore them completely, as shown in post #4 of the NEWBIES sticky thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sorry I didn't explain properly. I sent a template letter to UKPC, they sent me one back, telling me I have the right to appeal to POPLA. I did so explaining that the car with my registration was not parked in the location stated. Reply below. Please note I never said I was parked anywhere at any time. I only mentioned the registration, and sent photographic evidence of where the car was allegedly parked, which did not match the location sent by ukpc.

The operator has provided photographs of sufficient clear signage located throughout the car park which clearly states vehicles must park within marked bays. No roadway parking.
The signage also explains that failure to adhere to the terms and conditions will result in the operator issuing a Parking Charge Notice (PCN) to the value of £100. The British
Parking Association mentions under section 18.3 “specific parking-terms signage tells drivers what your terms and conditions are, including your parking charges.
You must place signs containing the specific parking terms throughout the site, so that drivers are given the chance to read them at the time of parking or leaving their
vehicle”. I note the appellant the vehicle was not parked at the location in question, however, this does not detract from the fact it remains the appellant’s
responsibility to comply with the terms and conditions displayed on site by ensuring she is parked within a marked bay. I also note the signage clearly states that all
vehicles must park only within marked bays. No roadway parking. As the appellant has parked on a roadway she has breached the terms and conditions, there is also
signage clearly displayed right next to the parked vehicle. As the appellant did not keep to the terms and conditions of parking, by failing to park within a marked bay,
I am satisfied that the PCN was issued correctly. Accordingly, I must refuse the appeal.0 -

...you didnt explain properly to POPLA either.
What you needed to say was that as the location on the NTD was not correct, keeper liability did not apply.
However, this is water under the bridge now.
If you dont agree with the charge, write to the PPC again
Dear UKPC,
I do not agree with the POPLA decision. The assessor did not correctly understand the situation. The debt is therefore denied. Debt collection will be wasted monies.
I am prepared to use ADR to attempt to settle the matter and suggest the Consumer Ombudsman is a suitable body.
Then ignore anything but a letter before claim or court claim (or just repeat the letter above)Dedicated to driving up standards in parking0 -
dear me, the advice you were given was correct for a UKPC appeal
when they refused it and gave you a popla code, you should have come back for FURTHER advice on the next stage appeal, to popla, which would have had many legal arguments in it, but you didnt and paid the price for not getting more advice
now you will have to deny the debt and be harassed for 6 years by debt collectors, coming back if they try a court case using the small claims track0 -
Ok thanks for the advice hoo hoo, I honestly thought an incorrect location and postcode would be sufficient grounds. Clearly not. I will email them my response today.0

If it's only UKPC then they are unlikely to try court with a single PCN and it's defendable. Most likely you and this poster will get the usual DRPlus and Zenith letter chain shown in post #4 of the NEWBIES thread - perfectly OK to ignore that drivel. But KEEP all letters, in case.
Both of you just need to come back and start a new thread for yourself, if you get small claims paperwork = defendable.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
