No fault Claim Insurance small claims ? Excess more than Value

yeah I would get the excess back but it means paying 750 upfront and unlikely but I might lose.

If you have got legal cover then contact them
Legal cover is really just uninsured loss recovery. Your loss reported here is uninsured

You sound unsure whether you would win so unless you have any legal cover with your insurance is it worth risking more money on court costs for the sake of £250 ?
By informing your insurer you have already ensured that your insurance will go up whether you are at fault or not. You are now perceived to be a higher risk.
Have you made it clear to your insurer that you don't want them to repair the vehicle whatever the outcome?0 -
I already told them I don't want them to repair the vehicle.
If I can claim off the Insurance company under small claims then I would like to do that. the cost for this is not much. While I think I would win over this. I can't justify risking 750 but the cost of the Small claims I can.

You misunderstand the situation.
You say you have legal cover. This is to be used to get back any uninsured losses you have (ie costs not covered by your policy)
This repair bill of £250 is not covered by your policy.
So use your legal cover to pursue the third party for this at no cost to you (win or lose)!0 -

Likewise, if you were going to pursue this via the small claims court you would need to be able to provide details of the driver.

You seem to also be confused as to the status with your excess (which I believe you are saying is £750)
A £750 excess means that for any claim less than this amount, your insurers are not interested as you have agreed to be responsible for the first £750 of any claim you make for your own damage.
As £250 is less than £750, this is the amount of your vehicle repair claim and you do not have to stump up £750.
As to what you do next, can you please answer these questions so we can advise you what you can do
1-Do you have legal cover with your car insurance - Yes/No?
2- Can you identify the responsible vehicle reg number?
3- Can you identify the name of the responsible driver?
4- Do you have any contact details for the responsible driver such as phone number/ address etc?
5- Do you have the contact details for the witness?0 -

You claim from who ever is negligent. If you can't identify who is negligent, then there is no claim.
I.e if someone steals your car, tears off, crashes into another car and runs off and can't be caught you can claim off your own insurance (if fully comp) for your own repairs but the third party whos car got hit can't unless the driver is caught and can be identified.All your base are belong to us.0
