So, here is SP's evidence pack.
My appeal points
1. Signage
2. Landowner authority
3. BPA CoP breaches
4. Unreliable, unsynchronised and non-compliant ANPR system.
5. GPEOL
Smart parking's 'evidence'
1. Signage - SP basically state "There are signs at the entrance of the car park" and "There are an additional 23 signs situated around the car park".
They go on to repeat this BS several times.
To back up these claims they include several, almost identical, old, irrelevant images of signage that may or may not be at this particular site. They also include two grainy images of my car with a pcn stuck to the windscreen.
What they failed to include was a site map, photos of entrance signage and up to date photos of signage within the car park.
I suspect this is due to the fact that the entrance signage is like a postage stamp, 12' up a lamp post, with no form of lighting. Also, the site in question has 3 separate car parks and the 23 signs they mention are scattered across all 3, which in my opinion makes 2/3 of them irrelevant.
2. Landowner authority - SP just state that they have a contract but won't be coughing it up as it is commercially sensitive.
3. BPA breaches - more BS from smart.
4. ANPR - SP claim they don't use it in this car park.
5. GPEOL - no mention.0 -

How the hell did the assessor determine that the signage conforms to the code of practice?
There was no evidence whatsoever to prove this.
The assessor states "the appellant parked directly infront of a sign"..........really???
The tiny sign behind my car that says 'car parking' is actually referring to vehicles and contents being left at the owners risk.
Was it really necessary for the assessor to expand on any appeal point other than the one it was allowed on?
Anyway.......we won! :beer:0
