First of all thanks for the advice everyone.
I first registered my appeal with popla and received the info regarding transfer to ombudsman.
I then searched Google for some similar cases and found a very close match. A guy in the same store that didn't buy a ticket and asda customer services cancelled it for him.

I then emailed customer services again. The guy gave me the address for the exec relations team. .......Not without first having a snide dig regarding the obvious though!

I decided to play by their rules and send a letter to the address they provided.

So......... I thought that would sort it but to my amazement I have just received a reply from asda which is pretty much an echo of what customer services have already fobbed me off with. What on earth are they playing at?

I like how it says "as a regular shopper, you are aware of the pay and display". Does this mean if I wasn't a regular shopper they would have a different view of what happend?
This person has also made the assumption, presumably due to the spelling of my name, that I'm female. Last time I checked............. I was in fact.... male. :rotfl:
Anyway, what will asda actually gain from sticking to their guns With this?

Simple answer....Asda share the revenue with Smart Parking from PCNs and then use their income to masquerade it as giving to various charities.

I doubt this is genuinely ASDAs stance on this matter so it's a case of getting through to someone that has some influence/common sense.

As our local Asda is not infested by a ppc and there is no problem with parking (AFAIK) then it can only be that the management have been conned into it by PPC It would be interesting to see if business improved or worsened after they are involved.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

First of all I will set out the questions, I feel, still require answers:-
Despite numerous claims that ASDA are powerless to cancel the parking charge, I know this is not the case. I have evidence that ASDA have in fact cancelled parking charges issued at the same branch, for not displaying a ticket. With this in mind, why is it that I am being discriminated against? in addition to this, why have I been told on more than one occasion that I can be offered no help on this matter? I know this is not the case.
Do ASDA have something to gain if smart parking manage to extort money from me?

Here is the question I believe you attempted to answer.
It has been pointed out that because I was a regular customer, I knew the rules of the car park. Does this mean if I wasn't a regular customer, you would treat me different? How is this fair?
Now what I meant was, if I had received one of these 'parking charges' whilst shopping in your store for the first time and subsequently complained to customer services, would you have cancelled the 'parking charge'?
By you making the point that I was a regular customer and therefore know how the car park works therefore implies that this is one of the reasons you are unwilling to cancel the charge.
I also made the following statement that you have again overlooked.
If you are unable to answer my questions, I politely request that you escalate my complain to someone that is able.
As you have failed to answer my questions, I take this to mean that you are unable to.
Therefore, I would again request that you escalate my complaint.

I’m sorry you feel I have overlooked the issue.
You asked if you would have been treated any differently had you been a new customer to this store, no you wouldn’t. The amount of the notice is set by Smart parking and clearly signed in and around the car park. It is not a per minute or hour payment, it is a set amount.

I could have parked in your car park, paid £1, and wandered off in to town without spending a single penny in your store, no problem. Instead I don't pay the £1, spend more than this in your store and get a parking charge. Where is the sense in this?

If ASDA decide, against all logic, to uphold their stance on this. I can only be held accountable for the losses/genuine pre-estimate of losses incurred by land owner due to my actions. How much would this be, £70? I do not think so.
Finally, May I point out that I am not aware that, at any point during our communications, I have disclosed my gender. Therefore, it is quite rude that in the most recent correspondence I am addresses as Ms. What has this assumption been based on?

Hey guys.
Ombudsman services have been in touch to say I can now submit my appeal.
I see that there are some concerns regarding the website and online uploads. Is it recommended to appeal by post instead?
I have my draft appeal ready. Would you guys have a look at it and give me your thoughts please.
I am going to include a copy of my receipt from the day but I'm not quite sure how to word the explanation of what happened without it sounding like bull**** mitigation.
Do I need to include anything else?
I'm not sold on the anpr part because the parking attendant took photo of my car and I'm unaware they operate an anpr in that car park.
I have taken most of my appeal from legal beagles, courtesy of mystery1.
