Old Credit Card PPI Claim

Having successfully claimed back PPI on a loan, thanks to all the help I got off here, I'm now looking to do the same with a credit card. The loan was pretty straight-forward, as it had PPI on it from the beginning (i didn't realise at that point), I had statements and some of the original paperwork and had ended just under 6 years ago.

However, the credit card may be more tricky, and want to make sure I go into it properly. The account was opened up in 2001. I didn't realise I had any policies on there until about 2007/08 (ish) when my balance started to build up. At this point I cancelled it when I found out what it was, but must have paid 100's over the years.

The credit card account is still open (policy cancelled), but I don't have any of the original paperwork (I signed up online). I'm thinking the chances of succeeding are quite slim - is it best i do an SAR before putting a claim in.

Is it possible they could have all the paperwork still themselves (as the account is open)? I'm afraid they will dump any reference to PPI if I try and claim, wheras doing a SAR first may mean I get the information I need to make a claim? Could I trust them to be honest by going straight into a claim?

    If the cc is still in use, make the complaint because you already have the account number.

    Be aware though, if you bought it online, then it can't have been missold to you, because no one was present to advise you to have it.
    Some people have had success despite this, you won't know till you try.

    I don't think you need to do SAR because the account is still open. The lender should have all the records it needs to conduct an investigation. I'd be very surprised if they could not locate the earlier PPI policy, if that what happens you could send a SAR.


    If you decide to make a complaint, as you applied online the sale of PPI was non advised so the bank might reject it on those grounds, however there could be other reasons for it being potentially mis-sold e.g. self employed or pre existing health issues at the point of sale.

    You dont need to do s SAR. That is only required by people that didnt know they had PPI and dont want to ask the card provider. You say you had it. So, a SAR will not tell you anything you dont already know.

    If you applied online then what exactly is your complaint reason?

    Brilliant, thank you for the replies. I wasn't sure if they would have any details of the policy, as it was cancelled when I realised I had it.

    I was young when I signed up for the card (it was my first ever credit agreement). At the point of sale, I genuinely didn't realise there was an insurance with it (think it may have been called sentinel) - I didn't specifically accept it, or see anything at all about it. It was only as my balance built up I noticed £££s being charged every month, and didn't realise what it was - I cancelled it as soon as I did.

    I guess you could say I should have read the details more carefully - I'd even say that myself, but hindsight is a wonderful thing.

    I think you've been reading too many spy novels! This sort of thing does not happen in real life. Most banks don't keep paperwork longer than 6 years but tend to keep electronic records for longer. To dump paperwork would be more likely to hinder than help them. The paperwork is designed to evidence that the sale was conducted compliantly - they are likely to find it a lot easier to defend a complaint with it than without.

    You've answered your second point with your first.

    Missold means that you were given false, misleading or inaccurate information about the product or wrongly advised to purchase a product that wasn't suitable for you. If the OP applied online then nobody advised him/her to purchase it and nobody sold it to him/her. That basically means that if the policy wasn't suitable (e.g. for the reasons you have stated) then it was misbought, not missold. The only way you can really argue missale with an online sale is if the information provided in the online terms & conditions etc... was materially misleading (or in some cases if there was a pre-ticked box for PPI).
