I strongly suggest that you go down the PITA route, although I suspect that you will be very lucky to get the price that you hope for so will probably need more than the £2500.

If you have given up work to care for a family member then maybe you should be asking your family to help you out financially - and then try to develop the same penchant for bus passes that you currently have for cars that you can't afford.

It would be 'irresponsible' if I couldn't have afforded the car at the time of agreement, a year ago, which I could have and then continued to do so throughout the length of the contract, but as stated, due to personal issues I'm having to take alot of time off work and soon I'll be out of work all together. This is something I could not have predicted. The previous car was a hire purchase, meaning that you can either hand it back, buy it or take another lease out for another car. I chose to hand it back then some time later the FCA got in touch saying that the company had irresponsibly conducted themselves by not carrying out the necessary affordability checks before instructing the company to give me all of my money back. And to be quite frank, I came here for advice -- not a judgement.

So you werentmis sold the finance then and you have no case with the ombudsman

Just because one is ELIGIBLE to take out a car on finance does not mean they can AFFORD it. Truly affording a brand new car is paying for it in outright cash (if you're lucky, get one with 0% interest) but you still have that amount in cash to pay for it in full whenever you want.

So congratulations, you have an entry level BMW 3 series M Sport (I presume the 320d or the like) and now you want to get out of the finance agreement. Mental note, don't go for fancy cars you can't afford.

Or worse still, pretend you can afford a leased M3 which is a figment of your imagination, or that you've purchased and collected a car which exists, but is still for sale, and then make up a fantasy review of said car...

That was no doubt a legendary thread. BeenThroughItAll would you concur that the E92 M3 is superior than the Lexus IS250? Given the choice between the two which one would you rather have?

It was a good thread. The OP was, without doubt, a legendary bell-end... and to answer your question, 'Neil', neither. I'd have my E39 M5 back thanks.

You've called him a bell end now he's gone. I hope you've not upset him. Again :rotfl:
