PCN - New Generation Parking (NGP) and POPLA appeal result.

Would anyone like to chime in on this one for me?

Just came home from holiday to a letter from New Generation Parking Management, trying to charge me £100(!) (£60 reduced, as they're a BPA member) for parking in a small Marina car park in Cardiff the weekend before last.

The thing is though, we actually PAID for the parking! We had a sodding P&D ticket on the dashboard, covering us up until almost 4:00pm, and the date time of the 'event' on the 'notice' is 09/08/15 at 3:32pm (the notice date itself is 13/08/15 btw). Of course, I paid in coins (about £3 or £4) and I can't find the actual ticket now is it was well over a week ago so I can't provide proof. BUT, I think I remember having to punch my car registration into the machine to get the ticket - so can I ask them to check that data somehow? Also, their 'notice' has a picture of the rear of my vehicle on it?!?! How the hell is that proof of anything? It could be parked anywhere, and they haven't shown the front windscreen or side windows where it is common to display the tickets? Is that kosher too? What burden of proof lies on them to show someone has breached their rules?

I've been reading the FAQ's and then reading through the legalese that is POFA 2012, and I'm trying to figure out if it is actually kosher as a NTK - the only thing I can pick out maybe is the fact that they haven't stated whether or not a Notice to Driver was either issued or not (according to THIS parkingcowboys co uk/keeper-liability/ PAGE under the Notice to Keeper section on ParkingCowboy.

But I can't be sure if that's a real requirement or not or if it only applies if a windshield ticket was left or not - reading the actual POFA text (or any law text for that matter) is an exercise in frustration.

I suppose I can put up a picture of the notice if anyone would like to scope it out?

!!!!!!, I PAID £4, and now I'm being stiffed for £100! This is wrong on so many levels...

    Standard appeal to them On signage GPEOL etc and then POPLA , no mitigation

    Umm, sorry, could you expand on that a little? I understood the POPLA appeal reference, but not what you meant with the first bit, or the 'no mitigation'.

    To get to POPLA appeal, I know I've got to engage their own appeals process first to get a code (I have been reading, honest!) - on what grounds though - do I say "Oi, I had a ticket on my dash!" or something else? Also, should I allow 21 days to pass before appealing or just go for it now?

    as you have received a postal letter you appeal using the template letter in the newbies sticky thread, as soon as possible

    so when you say"what grounds" , the template ltter sets out the grounds

    an extra point can be "the driver paid for a ticket and here is a copy of that ticket" and add the copy to the appeal (keeping the original safe if you have it)

    if you dont have it, just use the template and appeal before the 28 days has passed, ideally asap

    PS - as above, I don't have the ticket any more unfortunately. It was cleared out of the car just before we went on holiday probably.

    in future keep those tickets for say 1 to 2 years, just in case, as its your proof of contract, just like when you buy a tv or cooker

    the thing about this sc@m is its all in the sticky threads, been on tv like watchdog and dont get done get dom, videos on youtube, go to parking pranksters blogsite and read his blogs , so there is a wealth of info you could read and watch to get up to speed on the topic

    we will point you at what you need, we wont spoonfeed you though ;)

    send the template letter as is seeing as you have no proof of purchase

    what you have received is a speculative invoice, nothing more , its an unregulated industry so just look at it as a demand for payment of an alleged debt which you need to respond to using the template

    Right, so I'm typing up this letter now - I'm taking the template from the newbie thread pretty much as is and tacking on the needed contact info. I don't need to amend the list of reasons making up the challenge do I!?

    Pretty awesome template letter too btw, polite but firm and specific. I look forward to posting it tomorrow.

    So, you're saying don't send it as recorded delivery?? Proof of posting is what though - a normal receipt at the post office? Or video of me putting it into envelope and paying over the counter, lol?

    Yes .... its a well know ploy for PPC's to refuse to sign ... therefore your letter never gets delivered :eek:

    Proof of posting certificate is an excepted proof in such dealings
