My PIP claim was rejected, what now?

Hello,

I'm without a doubt certain I want to appeal, however, I do not know how to go about this, and my research hasn't been much help. I read something about filling in a appeal form, however, I wasn't given one with my PIP decision, and, the letter mentions nothing about the possibility of appealing what so ever.

I'm also baffled as to how they reached the decision that I'm not entitled to PIP :(

For example, it gives a list of the points system that I have 0 points (total rubbish).As a small example, I cannot cook a simple meal, and stated good reasoning for that within my claim and medical interview. The form has decided I can apparently. The form also states I can manage my own medication, which I cannot.

There are many other things that I explained clearly and with good reasoning and evidence within my claim that seem to have not even been read! It's as if they reviewed a different case entirely.

I know I must act quickly as the letter is dated 10th August so don't have long to make get appeal sorted. How exactly can I make an appeal? I'm really upset and don't know who to turn to :o

    Before you appeal you need to do a mandatory reconsideration for them to look at the decision again. You must do this within one month of the date of your decision letter. Only after this can you go to an appeals tribunal if the decision remains unchanged.

    but I would strongly advise you to get some help with this either through a welfare advisor/CAB/CAB referring you to an organisation who could help.

    Without being intrusive, is your work in contradiction with what you say you can't do? A PA must be highly organised, it is difficult to reconcile that with being unable to manage your meds.

    Perhaps two people using the same account?

    Should have probably mentioned that this is indeed a joint account, apologies for any confusion.

    However, I am a Business Admin, but, this shouldn't interfere as I have no recollection of mentioning my job details, not even at the interview.

    Hmmn.

    Did you submit any medical evidence to support your claim? Difficult to understand how you didn't mention your job at any point in the application, do your care needs not affect your work in any way, are any reasonable adjustments needed for you to fulfil your role?

    My auntie got nil points at the medical. We asked for a mandatory reconsideration, but that stayed the same. I helped her appeal and we are now waiting for the results - she didn't want to attend the tribunal. It seems everything she wrote on her PIP form was ignored, as was medical evidence submitted. She went from Low Rate Care / Mobility to nothing.

    Are you migrating from DLA to PIP - only asking as you imply it in the quote above?

    PIP doesn't have a low rate only the equivalent of mid to high rates from DLA.

    In the case of my auntie she was migrating from DLA to PIP. She should have scored sufficient points to get Standard Rate Care at the very least on her PIP claim. It's about 7 weeks since we did the appeal now.

    I have to admit I find it difficult to understand that you can manage to work in admin and yet you cant cook a simple meal at home or take your medication ?
