Purchased a new Samsung TV

I purchase a brand new Samsung Curved TV in April this year, and now it won't switch on. Can I please have anything legal to quote to the company so that they have no alternative to either fix or replace it. Thank you.

    As it's less than six months old the retailer needs to prove the fault is not inerrant.

    Just to expand on ChumLee's answer - as it is less than six months old the retailer needs to prove that its not an inherent fault - if they can't they need to repair, refund or replace. This is done under a piece of legislation called the Sales of Goods Act.
  • I purchased from on online internet provided, the name excludes me for a second, but I have done a google search and noticed that the majority of Samsung televisions have this problem. I am just wondering if there is any trades description, or warranty laws I can tell Samsung in order for them to fix it. I am agoraphobic and live in a block of flats and I use my television to look after the children in my block, some of whom are deaf.

    It's the retailer you need to deal with not the manufacturer.

    Have you contested the company you purchased it from and explained it's faulty?
  • But shouldn't the manufacturer have the right to rectify it? As the warranty is with them not the shop?
  • I have not been able to contact the company as the fault happened at 8pm and their telephone helpline closed at 6pm. I will however be showing my grievance at 9am when I call them, this is why I am asking for legal advice to help my case.

    This depends - if you want to claim under the warranty, then Samsung will fix it in accordance with the warranty. If you want to claim under SoGA then you should go to the retailer...although they'll probably just send it to Samsung for repair. So going to Samsung might well be quicker

    It should be under warranty so give Samsung a call and they will arrange it. I don't see where the problem is here the first thing you do is call either the manufacture (quickest and easiest way) or the retailer who has the legal responsibility under SOGA.


    You can quote all the legalities in the book but Samsung will pass the buck back to the retailer if they can't fix it or it is uneconomical for them to repair or replace. The retailer then needs to provide the remedy.


    Is it a reputable retailer?
