    Having reviewed the evidence we hold and the points raised by the appellant, our appeals team were satisfied beyong any reasonable doubt that the signage was clearly detailed to the motorist at time of parking.
    All customers that use the facilities in our car park must enter their registration once they go in to one of the busineses. Based on the fact that the registration was not provided we have to assume that the driver did not use the facilities at the time. Our car park is free flowing as it is designed for uses of the facilities that provde their registration details. The landowners (a hotel) charge anywhere from £60 per night upwards for their room and the average restaurant and bar bill for other businesses would average between £60-£100.
    Signage clearly states that parking is only permitted when using the facilities. The businesses that have free parking are listed on the signage. A small grace period is given for all vehicles parking on site.
    Please note, we do not issue tickets at this site; it is managed in the same way an ANPR camera site so we can check data logged from the businesses the following day before any notices are issued.

    Since they are not the landowner this is merely a licence which would have been communicated by signs - and is a gratuitous (free) licence
    A small grace period is given for all vehicles parking on site.

    This is a term that has been added after the fact and not included in the original terms. On the basis of contra proferentem and the absence of fact and the inclusion of only opinion, the matter should be thrown out.

    Is it just the briefly written 'case summary' that appears on the POPLA portal? Presumably it also says 'the operator will send you the evidence pack separately'. That will be the photos and other evidence and has to be posted to you by the operator.

    So reply to POPLA and tell them you have not got the postal evidence yet so require an extension of time to comment, please, seven days from when you confirm the evidence pack reaches you.

    If you have not received the evidence by tomorrow, email the BPA to complain, without saying who was driving of course. Tell them your POPLA number and PCn number and name and address but identify yourself only as the keeper appellant.
