Mis led by EE?

I have been with EE for a little over a year now and I am currently paying £44 a month for a Samsung Galaxy S5. I recieved a call yesterday stating that I had a good credit history with EE and as a reward has been offered an upgrade on my plan to include a new iPad mini. On the phone I was told that I could have the iPad for an extra £23 a month and no up front charge. I was also told that ORIGINALLY the iPad would cost £40 something (I can't remember exactly) a month and would usually have an up front charge of £129. As I was being offered the ipad for roughly half the original monthly price and with no up front charge, I believed this to be quite a good deal. At first I asked if I could get back in touch as I wanted confirm with my girlfriend to see if she would like the iPad as an extra present for her birthday, which I was told I was unable to do as the offer only stands for that day alone but I would have 14 days to return the iPad if I was unhappy etc. I decided to go ahead with the deal and then look into it further afterwards as I knew I had the 14 secure days to return.

This is where my problem begins. As above, I was led to believe that I would be receiving an iPad for almost half the original monthly cost minus the £129 up front charge. Firstly I contacted support through live chat and was told that I was only in fact going to recieve an iPad mini 16GB with 10GB 4G data. This is only £23 a month and only £49 up front as it stands anyway, regardless of me being a customer already and being 'rewarded'. From the 'original' price that he qouted (the £40 a month and £129 up front) I can see that those prices almost match the highest spec iPad Air 2? I feel that I have been mis sold as the prices on the website did not match and the 'original' prices that the representative kept quoting in the slightest.

Can any tell me if this seems like I may have been mis led? I know I can return the product as soon as I recieve it (probably tomorrow), I just wanted to check and see if I should in fact be eligble for something more or if I have been told incorrect information.

Cheers,
Tom.

This is something every network will do to try get you to extend your contract with them or in this case add more to your monthly bill. Why did you contact support if you were happy with what the guy told you?

I suspect maybe the salesperson on the phone gave the costs for the lower spec model and then changed it to the Air 2?

You're entitled to return the ipad and not go ahead with the contract - besides that - probably not a lot more.

Companies do this all the time

I had virgin try to sell me sky movies on a good deal.
They have 2 packs with different movie channels in them and then a bundle of them both for cheaper. They were offering the full bundle, but quoting the total cost of each separate pack added together. They also quoted the price per month, but quoted my offer price as per week so i looked like i was getting it for less than 1/4 of the price. Of course if you actually work it out, it wasn't a special offer at all, just their standard price for the full bundle.

Its like £15 for each pack, or £20 per bundle. So they quote the price would usually be £30/month compared to the offer of (roughly) £5 per week.

£5 down from £30 sounds like a pretty good deal (until you look at it properly)

It's their usual up selling. I was offered a free iPad from them, if it really were free why didn't they just stick it in the post to me? What they're actually selling is a data plan same as when I got my iPhone. That was free but I had to pay to use their network.
  • So other than sending the iPad back there is not much else I can do? I've contacted support but they seem to just direct me to someone else each time. Are they allowed to lie about prices even if they are giving you the product for cheaper? I accepted the offer in the first place as I thought it was a good deal and a 'reward'. Apparently its more or less like buying one anyway minus a small up front charge which was overly exaggerated.

    Pretty Much.

No - proving they have done that without something written is hard though.

Exactly this - its not cheaper - you might as well just buy one yourself.
  • Would EE record calls as proof in cases like this? If they listen to the call again it would be clearly heard that the representative says that the iPad costs considerably more than it actually does, making me believe I was getting a good deal. That surely can't be allowed?

You could certainly report them to trading standards or ofcom - but you'll still only be entitled to send it back for a refund.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • Quick update, finally got through to someone helpful on the live chat (I'm currently in work so can't call). Apparently my issue has been noted, a manager has been informed and action will be taken on the employee who mis sold me the iPad (which does make me feel slightly guilty to be honest, but action should be taken). I have been urged to contact the upgrades team who will be aware of the situation and will look and see which plans are more suitable. I can update again this evening if anyone is interested if they get in the same situation or similar.
