The Courts service is a business.
More business the better as they are concerned.
They are profit driven, hence why they had an interests in Beavis, a financial one.
The Law society moves in mysterious circles.I do Contracts, all day every day.0 -
Fair play to you Enfield Freddy I did thank you for that
Today for my personal future intents and purposes I did win. I'll settle for that.
I wouldn't know how to go about even attempting to claim back the money I've paid them??
It is worth noting the judge said I won't get my money back and if they had opposed my set aside I would have lost as they have there signs all over the car park...
Interesting post Mark that the Courts are a business...then parkingeye are actually keeping them healthy!0 -
and a company that supplies services to the courts , and charges handsomely , is non other than capita , YES the owners of parking eye ,
so in theory , PE bring cases , the courts are short handed and get more capita staff in
wonder if capita supply judges yet?
in your statement above you said the judge commented "It is worth noting the judge said I won't get my money back and if they had opposed my set aside I would have lost as they have there signs all over the car park..."
did she/he have the case notes of the original case open? , if so WHY? , you were not there to fight the case (in your words) , just the legality of the sentence (CCJ) , parking eye could say the moon was made of cheese , it would be your job , via photo,s etc to disprove them.
sorry , something is not right here0 -
Of course my primary defence was that I didn't receive vital court papers. Which if recieved would have given me a chance of defending myself or paying the debt.
I'm not having a go at just you...but so called Forum experts/veterans quite clearly have poor advice in saying don't contest the judgement to have it set aside.0 -
Somethings not right here
I'm intrigued by this comment Enfield Freddy please expand upon this if possible?
As for the Judge having my case notes open...the decision was made before I entered the court no discussion, debate etc0 -
Your hearing was to see if you could get the CCJ set aside (not to determine who would win the case!)
The judge's comment seems unprofessional, as she was not there to judge the winner/loser of the original claim!0 -
Hi,
I'm happy to hear about your set aside of the CCJ.
I today have learnt I'm in the same position, I ignored PE as I was also told it was a scam, but never received any court letters.
The first I knew about the CCJ was when I applied for credit the CCJ is actually 12 months old and I had no idea it was there.
Just wanted some advice on how to appeal?
Hope your still active on here as waiting 6 years for a decent mortgage isn't very appealing.
Many thanks0 -
You can't appeal. You must pay £155 to the court and try to get it heard to be set aside.

HTHPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I managed to get a ccj set aside today. woop woop.
I had moved home around the times the claims letters went out. the judge used her discretion. my arguments were pretty weak to be honest but i basically begged!:D
now i have to decide whether to pay the original fine!0 -
