Right to return PC

Hi,
I purchased a laptop online from Argos, do I have a right to return and request a full refund even if I have used the laptop?
I have informed Argos that I wish to return the item but they have told me that they will only accept a return if the PC has not been used.
It is all within the statutory 14 days after purchase.
Thank you.

  • It's now second hand , and can no longer be sold "as new", what do you think Argos should do with it?

Argos can resell it as used or refurbished.

To answer your question J,M yes, you do have the legal right to return it under the Consumer contracts (information, cancellation and additional charges) regulations, but there is one important point that you must be aware of.

When returning unwanted goods under these regulations, you are only entitled to a full refund of the original price paid if the goods being returned haven't been used excessively by the consumer.
The regulations only allow you to open, inspect and test the goods to the same degree that you would be able to do so in a shop. The retailer is entitled to make a deduction (up to the full price paid) to cover any loss in value of the returned goods if the customer has gone beyond this.

As Argos would now be required to sell as second hand or refurbished, I would think that if they do make a deduction then it would probably be quite a good percentage of what you paid.

Hello shaun from Africa, thank you for your reply, it is what I suspected, but can you point to the relevant consumer legislation that I can quote to Argos, thank you again.

It's sections 29 to 34 that are the relevant ones. (and it's 34.9 that deals with reduced refunds).

gives fairly good and easy to follow explanations of the CCR's.

Define what you mean by "used"?

shaun from Africa , Having spoken to Customer Services and I believe their online sales dept, quoting the 2013 Act and relevent paragraphs, Argos in their wisdom are adament that under no circumstances will they offer me any sort of a refund.
I used the laptop for a maximum of 5 hours, long enough for me to decide it was not what I required.
So, where do I go from here?

Did the entire transaction take place online - ordering and payment - or did you order online and pay and collect in a store?

What kind of laptop is it and why do you think it doesn't offer what you require of it ?
