UKPCS total fitness wilmslow disabled parking

Hoping for some advice
Went with step son, in his car , registered to his address...partner and grandson to the gym. Parked in the disabled bay but forgot to put in my blue badge
Came out parking ticket on window

I sent an appeal enclosing a copy of my blue badge and putting my address at the top of the letter
Appeal rejected and demand for £100 sent to my address

Ignored it. Rightly or wrongly and have now had a further demand for £100 as out of time to appeal through independant appeal

What should I do, my opinion is that they shouldn't have transferred the thing into my name. Just because I wrote to them showing my blue badge

What should I do. Wait for them to take me to court if they go that far.
Thanks in advance

What did the manager say/do when you told him/her that their agents (UKPCS) were pursuing you, you have a disability that means that you are entitled to disabled bays/adjustments under the equality act.
And you demanded that the manager cancel the ticket as if they don't you will consider him/her to have breached the Equalities act?

What happened when you did that?

Please confirm the name of the parking company. Are you sure you haven't transposed some of the letters. This is not me being picky; there are several companies with very similar names and initials, so we need to be sure we are dealing with the right company.

I can't find a company called UKPCS, but UKCPS are IPC members. They run a kangaroo court appeals system so you may need to go into ignore mode. Have a read of the Sticky thread for NEWBIES as this will tell you all about appealing parking tickets.
However, it is extremely unlikely that an IPC member would risk court as they know they would get the book thrown at them for making such a ridiculous claim.

Landowner cancellations are always the best way to get rid of these scammers, so the gym manager/owner should be your first port of call. Tripadvisor, Fakebook, and gym website are also there for you to make good or bad comments, ;) as are the local and national press,

If this is UKCPS, did they send you a v.a.t. invoice? They should have as they use a contractual charge regime.

You may ask for a vat invoice and if they do not send one it cannot be a contractual charge, but a breach of contract and they must acccoun for their losses. If you suspect tax evasion go here.

If if is UKCPS just appeal to the PPC and the IAS. If the IAS reject your appeal you are home and dry, their anonymous adjudicator will have made such a hash of it that they will not want it to go anywhere near a court.
You never know how far you can go until you go too far.

    Needs some more clarification.

You appealed from your address and were sent a rejection.

However, you don't say if you are the registered keeper or even the driver.

Does the notice to keeper have the registered keeper's name on it.

The point I am getting at is if you were neither RK or driver and if the RK does not live at your address, then there is no charge to answer.

The original letter went to the owner and registered keeper of the car. My stepson. However when I appealed I included my address bing the address where the blue badge is registered to me. They have effectively transfering the debt or charge to me

there is a PCS in the BPA , and a UKCPS in the IPC

I can find no info on the PPC you claim it to be !

UKCPS typically do this with disabled bays and Blue Badges

I suggest you read the paperwork again and make sure you and we know which actual company you are dealing with

when YOU appealed, what entity did you say you were ? driver ? keeper ? Registered Keeper ? what ? (you had to be an entity to appeal)

the BB may be registered to you but is not valid on private land

They have no right to do that, unless you have admitted to being the driver. They are now pursuing neither the driver nor RK. Please confirm that they have specifically demanded the money from you personally and that you were definitely not the driver.

You have no need to do anything else.

If you appeal to the IAS stating that you were not the driver and not the RK, then you should win, but they can then go after the RK subsequently. Of course, the IAS may be idiot enough to aphold the ticket on the assumption that you must have been the driver as you appealed!

But any court in the land - even one as ignorant as some of the ones we have encountered - would throw it out as you were neither RK or driver, simply a passenger. You have absolutely no liability whatsoever, unless you have accepted any in your appeal.

My advice in your case is to do nothing until any court papers arrive, if my analysis of the situation is as laid out in this post. (Normally I always advise an appeal to the IAS but your case is almost unique on this forum and needs a different solution)
