Minor car incident. Should you report to insurance?

I was involved in minor incident during rush hours. car was parked in front of me and i was driving to get past it while the a car was coming fast on 30 mile role in the front. This car brushed my mirror. My mirror came out while his mirror indicator plastic got cracked a slight.

Other driver thinks it was my fault whereas I said it was not my fault because he saw me coming and did not stop and continue to drove off very fast.

I was already passing parked car while he was much further away.

Driver did not exchange any telephone details but took pictures of my car reg and damage and drove away.

Should I report this incident to insurance company? As it is not worth the excess both of us may pay.

I am not sure what the other driver is going to do either.

    So you pulled out to pass a car parked in front of you, whilst another car was travelling quickly towards you and this resulted in damage to the mirrors of both vehicles?

    Sounds like you didn't allow enough room for the oncoming vehicle to pass safely.

    Did you cross over onto the other side of the road to pass the parked vehicle?

    All incidents should be reported to your ins co.

    You should but it's up to you whether you do.

    It was slightly tight for the other car to pass through. However if he had controlled the speed it would not be a problem. I was more than half way to pass the parked car anyway. I believe in this case the front car should have slowed down or stopped to let me finish passing. I was 50% on both sides of the road.

    I read on other threads some people have notified insurance company as "informational purpose" rather a claim. Not sure if this would be good option.

    I do not need any repair work anyway. I fixed the mirror myself as it was very minor problem.

    If you had shown some restraint, having seen the car coming, waited it wouldn't have been a problem.

    Agree but his car was much further away and I had ample time to pass through. I already made it more than half way through. If I was in his place would let the passing car clear the way.

    Would you still carry on driving 35-40 miles on 30 mile speed road even though looking at the car in front of you?

    Not sure how the insurance company see this though.

    "ample time" would mean you had passed the parked car and returned to your own side of the road.

    How do know the speed of the other car? If you thought it was travelling too quickly, you should have waited.

    And you can prove he was doing that speed can you?
  • From what you say you were at fault for the accident, particularly if there are no witnesses. His speed is broadly irrelevant, you should always judge the speed of other road users and base your decision on that.

    You had the greater duty of care as the one performing an overtaking manover and you've misjudges the space/ their speed/ the time the manover will take.

    Technically all incidents have to be reported to your insurers, if people do or not is a different matter. Your excess isnt payable if the TP makes a claim against you just as long as you dont claim for your own damages.

    Having not exchanged contact details the TP will find it much easier to claim from your insurance than to reach out and talk about settling it privately thus preserving your claims history.

    Sorry op but your at fault why?

    Because the hazard (parked car) was on your side of the road, you should have either stopped untill there was no one coming the opposite way

    You cant expect people coming the other way to slow stop when they path/route is clear

    sorry I know you dont wanna hear that but thats the way it is

    (Also i hate it when people are driving and the car in front of them indicates to turn left, instead of slowing/stopping and letting the car go in the just swing out to the right coming half on the other side, expecting the oncoming traffic to slow or stop. Its annoying and is common similar to what happend with you) sorry
