Missing credit agreement

Hi,

Sorry there may be a thread already but I cannot see.

I've recently started a personal claim against Yorkshire bank/Clydesdale bank over possible PPi on my credit card (had for 20years +)

As no PPi info on my statement a requested a copy of the agreement (sent £1 cheque etc). I had a letter which stated my signature didn't match records so I had to go to branch to prove. Done.

Just a received a letter stating that my agreement is lost, but they are still trying to find. Advising I should however continue payments and returned my cheque.

They ended by stating the PPi team will respond to my enquiry.

Is this the norm and should I just allow the usual 12-14 days for a response?

    If you pay any PPI, it is itemised separately on every monthly statement.
    So, 20+ years, that's over 240 statements, with no mention of PPI?

    You don't need the agreement.

    Why do you want a copy of the agreement? When you say you've started a Personal Claim do you mean you've sent a complaint, if so the PPI team have 8 weeks to deal with your complaint. If there is no PPI info on your statement would this not mean you don't have PPI anyway, at least not currently, or are you thinking you used to have PPI and cancelled it in the past?

    Who told you that, a lying claims management company?

    Think about it, how would it work?

    If any PPI payable is not itemised, then it isn't charged and you wouldn't pay it.
    It's a myth that it's hidden in the interest.

    ETA:

    No, if you've put in a complaint, it has to be investigated thoroughly. If you'd just phoned and asked they may have been able answer there and then.
  • Why would I approach a "lying" claims company when I've advised this is a personal claim?

    My wife has won a claim from barclays cc, exactly the same circumstances, no PPi info, no myth

    Please explain how you could pay PPI charges if they are not on the monthly bill? I'm intrigued.
  • Since a 2011 court case it has become a lot easier to reclaim yourself – though that doesn’t stop claims companies spamming, to try and get their 30%.

    Is PPI always bad?

    No. It wasn’t a bad policy. The idea of having your repayments covered if you were ill, sick or out of work is a good one. Yet bank policies were often given to people it wouldn’t cover and were massively over expensive - often the payout would only last a year and be far less than the premium costs.

    It is important to say – having PPI doesn’t mean you can reclaim it – you need to have been missold it as well.

    What counts as mis-selling?

    Companies were obliged to ensure PPI was suitable for the customer at the time they got the policy – and to explain relevant omissions. The main mis-selling categories include:

    Being told it was compulsory. Many were told this, and it’s simply not true.

    ***Not being told it was added – or adding it when you said no. Some people will be thinking they never had PPI - but they did - it’s just the cost was hidden within the repayment.***

    You've received excellent advice here jackson from knowledgeable posters, far more knowledgeable than your quoted source. Of course you are free to waste your time pursuing a non existent claim, but I would politely suggest you take on board the accurate information offered to you here.

    Sorry if this was a credit card PPI complaint you are referring to then your 100% guarantee means nothing. If you have PPI with a Credit Card then the charge shows somewhere on your statement - clearly itemised.

    On loans it may be that whoever sold the loan added PPI to the repayments they quoted but even then PPI is not "hidden" it well be detailed somewhere in the Credit Agreement.
