I received a NIP this morning stating my car was caught doing 35mph in 30 zone last friday 31st at 8.40pm approximately 40 miles from home. However I know my car was parked outside my house and that I was here watching TV at this time and couldnt possibly have been in that area, also I am the only person that drives the car.

I wrote a letter this morning disputing the fact that it was my car and have included photos of the front and rear of my car to be compared to the photos they have which i posted this afternoon.

Just wondering if I should have added anything else or do you think this was the right thing to do.

Thanks in advance.

Ask to see the photographic evidence. You have a right to see it. It should be clear that it is not your car, in which case the whole thing should be dropped. If it is your car, you will need to investigate :)
If someone is nice to you but rude to the waiter, they are not a nice person.

Does he or have you made that up? Maybe you should give him a link to the legislation giving him the right to see it should his request be declined.

I believe you are wrong, there is no right to anything.

    OP, go and post on

Do not forget that you still need to return the NIP though , and do not use the words 'evidence' when asking for photos. Evidence only needs to be produced if you end up in court.

It's the 172 request he needs to return not the nip. Make sure you do this and do not just rely on your letter. Else you face 6 points and a £500 fine for another offence.

He could ask for a photo to assist in the identification of the driver but what's the point? He's the only driver of the car.

But that would allow the OP to see if it was an entirely different vehicle or more likely the authorities will twig that someone has misread the number plate when processing the ticket and the OP will instead of receiving the photo(s) receive a letter dropping the matter.

But he's already written to them saying its not his car, so how will the photo assist in the identification of the driver. He cannot be expected to name the driver of a car that's not his.

If the OP is sure his car was at home at the time of the incident another driver/car might be using cloned number plates
Seeing the photo will confirm whether the registration number on the NIP matches the number on the offending vehicle.
If the number plate in the photo is the same as the OP's he will be able to see if it is his car of someone else's car

If you are 100% sure that your car wasn't being driven n that road then writing a letter to the police is OK but you must also send back the s172 notice signed by you with an explanation of why you can't name the driver.

There's nothing wrong with asking for the photos to help you investigate whether it was your car but Richard is not correct to say that you have the right to see the photograph; you don't unless the case goes to court.

If the police are not satisfied with your explanation you risk a prosecution for failing to furnish - automatic 6 points, fine, costs, criminal courts charge and victim surcharge - a lot more than a speed awareness course or a fixed penalty.
