gross misconduct season ticket loan

Hello,
Has anyone been subject to employer disciplinary hearing for misuse of company season ticket loans?
In other words getting an interest free season ticket loan (thats then deducted from your monthly salary) but not buying an annual train ticket.
Is it an open and shut case for instant dismissal?
Its at the investigation stage - should I resign before the actual disciplinary process starts to try and preserve an adequate reference.
(I'm desperately hoping as my (big) employer has not actually suffered a loss and my previous 4 years of perfect work record that they will do everything EXCEPT dismissal)

I work in financial services and I assume they would kick me out for that as it is fraudulent - the loss or the amount of the loan is irrelevant.ally.0

Unless you have mitigation I would class this as gross misconduct - you have intentionally deceived them. It is up to you if you resign, but even if you do they can elect to continue with the disciplinary procedure and/ or reflect the situation in your reference.0

If you resign they can proceed with the disciplinary in any case. And a reference could simply say "resigned while under investigation for alleged gross misconduct".
Are you a union member? If so you need to talk to your local steward or call the member helpline asap.0 -
I'd definitely say it could be gross misconduct. But how on earth did they find out that you didn't have a season ticket? And why did you take the loan for one and then not get one? Because the outcome is going to depend to some extent on what explanation you can provide.0

You have been provided with a loan which you are currently paying back!
Is there a policy document which prescribes for the loan to be used only for a season ticket and excludes anything else?

Generally season ticket loan agreement in companies state that it is to be used for the ticket only and that if you are asked, you have to show them that you have the ticket.ally.0

There is a difference between a loan to support you with access to do your job and a loan to spend on whatever that has nothing to do with work. Otherwise, what would stop any employee for asking for 0% interest loans for whatever they fancy regardless of their credit standing...0

I`m a Civil Servant, and this is classed as GM, and if I did it I would expect to be sacked.
Also check your staff handbook as your employer *can* refuse to accept your resignation until the process is finished - the Civil Service can.0 -
