I wonder if the mod(s) to the car was a factor in the accident?0 -
that is why I would like to resolve the problem and settle as quick as possible. I am not trying to turn the situation around, I want to resolve it in a reasonable way
So seek legal advice regarding going bankrupt ASAP looks to be your resolution0 -
This is a very unpleasant situation to be in.
Having no insurance and the police probing is likely to see 6 points and a fine and likely higher insurance premiums due to the "uninsured" marker it will leave.
As you were at fault you will be liable for all costs with the third party. The cost for a replacement vehicle if it's wrote off and repairs if not. Hire car charges. Legal fees (if applicable) and any personal injury claims.
You mention you can't afford this. Do you have any assets of value such as a house etc?
I would be seeking legal advise regardless. It would be the best way to get help to mitigate the costs. All your base are belong to us.0 -
OK take a deep breath as this is the situation you are in
1- You will be charged by the police for no insurance - likely result 6 points and a fine. It is worth putting in an appearance to explain your situation and that it was not a deliberate act and that you are going to suffer considerable financial consequences anyway as this may help to mitigate the level of fine imposed
2- The insurance company of the BMW will want to try and recoup their outlay as they can't claim it from the MIB. it will be down to them to assess if you are financially worth pursuing or not. Getting a CCJ against you does not mean they will get paid.
3- Any injury and uninused loss claims by the occupants of the BMW will be dealt with by the Motor Insurers Bureau MIB - most likely the claimants will sign a form of assignment & agreement which will then assign rights to the MIB to pursue you for reimbursement of their outlay once the claims are settled. Same rules apply with the MIB as far as whether you are financially viable.0 -

Strange it's on a Vauxhall forum, as it's also popped up on a fiat forum:
