  • If you've succeeded in writing off a brand new 4 Series BMW whilst driving on a 'wet country road' then this tells a story in itself.

    the ONLY reasonable resolution is that you buy the other party a new BMW, pay the fines for driving with no insurance, pay the legal costs so far, inform your current insurance company about the driving with no insurance and the claim, and pay the additional premium (if they don't cancel your cover).

    otherwise your looking at IVA or bankruptcy.

    and I wouldn't bother trying to blame the wet steep country road, you're supposed to drive to the conditions.

    Car insurance has become tighter in recent years in the application of rules such as grace periods or notification of changes. I can remember a time when you could change your car for another and merely had to tell the insurers "as soon as possible".

    The memory is still around. My boat insurance renewal reminder says that "Marine insurance, unlike motor, does not have a period of grace".

    But unfortunately all that seems to have changed, and you have to be on the ball not to get caught out. People even worry now about the 1 minute gap in insurance renewal at midnight when starting a new policy.

    The 3rd party will and are within there rights to put a claim in for personal injury here on top of the loss of a car so you could be looking at a hefty chunk of change on this one tbh.


    The Police do not recover cars from an RTA it is done via recovery Companies also, Only a little point against your post but it still makes me believe you may be stretching the truth somewhat.

    I have since received a letter from the police requesting my insurance documents showing cover at the time of the accident. I called them and explained the situation, and was told not to worry, if I provide my previous policy, and a brief cover letter, it would show that I was genuinely and actively seeking continuous insurance cover and had no intention to drive uninsured.

    I suspect you have misunderstood what was said there as there is no grace period and intent is not relevant. You are either insured or not (in this case not). Expect a fixed penalty notice for no insurance (6 points and a fine, plus your next insurance quote will almost certainly be eye watering).
    Under the assumption that people have 7 days to arrange cover,

    It has been a long time since this has been offered (I have certainly never seen it and I have been driving for 20 years).
    I have now obtained another vehicle as I need it for work and the family, and it is insured adequately.

    Have you declared this accident to your new insurers and the likely hood that you will have a no insurance conviction soon ? If not then do not be surprised if your new insurer cancels the policy. (if this does happen then good luck with getting a new policy with both a cancelation and a no insurance conviction so close together).

    I would suggest seeing a solicitor asap as you are looking at a bill of over £30,000 just for the BMW. Add on costs, potential injury claims car hire etc and you could quite easily be looking at a £40,000 bill.

    With the circumstances of the accident (as you describe) it is quite possible that the police will look at further charges (without due care and attention or whatever they call it now, it isn't outwith the bounds of possibility that they could try for dangerous driving but that is much harder to prove).

    Well.....the Police will have arranged the recovery company to attend!


    Why does that make you believe the OP is "stretching the truth somewhat" (presumably you are telling us you believe this is a pack of lies)?

    AIUI fixed penalties aren't generally given where there's been an accident, so if the police do take action it will be a trip to court.

    Certain parts yes about the driving and the fact of thinking insurance will overlap I mean come on pull the other one.

    First of all very sad to hear.
    And glad all persons involved are okay. Metal can be replaced.

    Now I have never heard of 7 days grace period. It was only in Road Tax Disc I believe.

    And the you get 7 days insurance cover when you buy a car from a dealer/garage.

    Once insurance is expired its expired. New insurance will take over if you are not renewing from previous insurer.

    You will need proper legal advice as the other car involved is a new M4 and I believe they will do anything to get the most out of you.

    Get proper help. And I really hope all is sorted.

    Also be careful when driving in wet conditions. :)
