Virgin restricting availability of new phones to Freestyle contracts.

I currently have two virgin mobile contracts, one of which is due an upgrade. I called virgin to find out what was available and have been informed that I can't have the phone I want on my current standard contract and would have to get a 'freestyle' contract. A freestyle contract requires a credit check which I failed. I am now being refused the upgrade I want on my virgin contract and no amount of threatening to take my custom elsewhere is budging them. I even told them I would be getting my broadband and TV services elsewhere if they were unable to accommodate me.

What makes this even more galling is that Virgin call me every few weeks to offer me _yet another_ contract at a preferential rate because, in their words, I am "A valued and loyal customer".

What kind of recourse do I have apart from the usual threats of taking my custom elsewhere? Someone has decided to restrict access to some phones to Freestyle contracts, I want to challenge that decision.

    I'd find out why you'd failed a credit check from Virgin Mobile myself.

    They do offer some contracts on standard tariffs but these would also entail credit checks (as would other Pay Monthly providers) so I'd suggest finding out what caused the refusal first before voting with your feet.
    It's not your credit score that counts, it's your credit history. Any replies are my own personal opinion and not a representation of my employer.

    The credit check for a Freestyle contract is provided by Equifax, and I know exactly why that failed. For a standard contract the credit check is performed internally by Virgin, and I would pass that (I already have two contracts and my broadband/TV with Virgin and have done for four years) but new models of phone are only available on their Freestyle contracts.

    So if you failed the credit check and you understand why ....what's the problem ?
    Are you saying they shouldn't do a credit check because your already a customer ?
