My last payment for my contract comes out this month then its over.

I am moving to 3 for a month by month deal until I feel the need to get a new phone.

I asked Tesco today for my PAC code and they said they would have to charge me around £30 quid to get my code as it's leaving early cancellation. I said I would wait to switch it over but he wouldn't oblige, that doesn't seem right?

You have to give notice 30 days before you wish to leave. You have come to the end of your minimum contract term, but to leave you have to give 30 days notice.

They will give you your PAC, I guess what you meant was they won't give you your PAC for free, which they are right to do if you haven't provided enough notice period.

It makes no sense to give a notice as getting a PAC will void it anyway.

No, they aren't. Even if some money is owed, they can't refuse issuing a PAC:

Yes, this is absolutely wrong. They must issue it immediately over a phone or within two hours by a SMS: What is the process for changing mobile provider?

The PAC is free. However if you use it to port within minimum term then an ETC may be chageable. But they can't charge you for providing the PAC or withold it until you pay.

They should issue PAC, if you use it before minimum term your final bill will be for the term... Tesco cannot refuse PAC issue, call and lodge a complaint with Ofcom and get a reference number of such and email Tesco complaints.
SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)
