I have not yet vacated the property the way she is talking she is wanting to with hold a lot from what I amd the agents have classed as wear and tear.. i tet her re this she now states she holds deposit has also mentioned she has spoken to my new landlord and will contact him again if theres any problems... as in why would she discuss my deposit with my new landlord in which i have already paid my months rent (ahead of me moving in) and signed the contract for?

Remind her of the laws regarding Libel and Slander. Silly person.

Think you need to get a letter before action sent, as soon as you move out.

If I understand this correctly you are still living in the property but are going to leave soon and if you pursue the deposit protection any further then your current landlord is going to contact the next landlord? Is that correct?

If that's the case just keep quiet about the deposit for now. By the sounds of things it hasn't been protected which is a requirement by law. This is a much bigger problem for your landlord than it is for you.

Once you've moved into the new place, when it's too late for your current landlord to do anything, send her a letter-before-action and demand your full deposit back within 10 working days. If she doesn't return your deposit then take her to court.

There's no point stressing about something that may or may not happen in the future.

Hi Yes your totally correct Im still here have another week and a bit to go, shes admitted she holds deposit states she has discussed this with my new landlord (why I do not know) and that if there are any more problems she will contact her (why I don't know)

I was getting stressed but your right stressed re what she is the one in the wrong the house is in a better state than when she left it, shes never visited in the 4 and a half years to do checks, I have never needed a handyman out over my full tenancy Ive been a very easy laid back tenant. But yes there are marks from wear and tear but nothing major at all.

So I will await handing keys over... have letter printed for the full deposit return and take from there...

also already signed new property contract and paid my first months rent. -
