damage deposit not in dps

Been renting for 4 years due to leave in the next few weeks, started discussing damage/security bond rang estate agents who said the landlord had suggested they had placed in dps..but never issued the reference number in which I should have.. i don't as I never received one.
Where do I go from here addressed it to landlord as yet no response.
This was a legal requirement and I understand they had not informed there morg company about it being rented out either so makes me think they not bothered with this scheme.

yes thats what the estate agent asked to do as no reference was on my file there is none there and landlord not responded to my question regarding this as yetBelieve you can win and you shall win !!!

Just to be clear are you in England or Wales?
If your deposit isn't with DPS then check the other 2 schemes just in case it's registered with them.
If your deposit hasn't been registered anywhere the write (letter, stamp, get proof of postage) and send it to the address for the serving of notices given in the tenancy agreement. Give your LL 10 working days to return it. You might even want to let your LL know that you know it should be protected and that the penalty for failing to protect it is up to 3 times the deposit. That might stick a rocket up his backside. If you get no reply then take him to court.

I spoke with letting agency they are looking into this as they have a ref number however when i have typed into all 3 schemes its not valid.

Forget the reference number. Go to the websites, type in the minimum details
Deposit amount name and post code etc. They'll tell you if they have it.
Job done.
If they dont have it, threaten court and accept nothing less than deposit x2. (IE your deposit back and an equal amount on top)0 -
Did your letter to your landlord ask her to return your deposit? Has she agreed to return your deposit? If not what are her reasons for not doing so?0

I have not yet vacated the property the way she is talking she is wanting to with hold a lot from what I amd the agents have classed as wear and tear.. i tet her re this she now states she holds deposit has also mentioned she has spoken to my new landlord and will contact him again if theres any problems... as in why would she discuss my deposit with my new landlord in which i have already paid my months rent (ahead of me moving in) and signed the contract for?Believe you can win and you shall win !!!
