Was it at DFS or the car park next to Iceland? Do a forum search on North West and a few results come up which will be helpful.REVENGE IS A DISH BETTER SERVED COLD0

It was the car park next to Iceland. I'm still a bit confused to be honest. So we send an template appeal to the PCP not mentioning any of the mitigating circumstances because they'll be ignored anyway as this is a money making outfit. Then do we or don't we appeal to IAS or not afterwards - the NEWBIE thread seems to say not to bother.0

In post #8 you say that they provided a photo of the signage presumably this was the NTK (notice to keeper).
Check that that signage photo is the actual on site as it may have been a stock photo. You are dealing with ex-clampers, so don't expect too much of an intellectual challenge.
Your first appeal is to NWPE. That is the soft appeal that will be rejected as they are only after your money.
The second appeal is to the IAS (IPC) who are a bit 'touchy' about members who don't put up the IPC signage.
I feel this is a rare case where a challenge can win at the IPC.
Follow the timescales precisely as per the NEWBIES thread (21 days only) after ppc rejection and E-mail only.REVENGE IS A DISH BETTER SERVED COLD0 -
Unfortunately, we have no checked the signage and it does say that they are members of the IPC.0

I will post up the photos I have and see if they are the same. It mentions IPC in the bottom corner but the rest of it is so small you can't read it.REVENGE IS A DISH BETTER SERVED COLD0

Hi all.
I'm kind of in the same boat and same car park but I was park right at the back. I drive a lwb transit that's total length is 19.8ft long. Now there bays are 15.7ft long so I had to park one of 2 ways. 1 park with the overhang out into the drive ways. 2 park with the overhang into the bay behind. I opted for number 2 as I felt this would cause less of an obstruction to fellow car park users.
I paid for 2 hours parking at a cost of £1:70 but was only away from the carpark for an hour. Upon return I had a nice notice on the car saying I was not parked withing the marked bay.
There is not a carpark anywhere in the town centre where I can fit in a bay so have always parked like this in all carpark I use unless it has bays for commercial vehicles.
Can somebody please shed some light on where I stand with this as i'm not in the least bit legal minded so all the jargon just baffles me. Do I appeal against the notice or do I accept I was in the wrong and pay the fine?
Thanks and sorry for hijacking a thread.0 -
No you don' pay the charge and it's not a fine!
Can you read and digest the NEWBIES thread at the top of the parking forum page. It's written by real experts.
Nowhere on this car park does it say that it cannot accept large vehicles.
Can you start your own thread on this and you will be guided through this process.REVENGE IS A DISH BETTER SERVED COLD0 -
GreenFields wrote: »Thank you for your replies, I really appreciate it. I have read the newbies thread already but just needed someone to confirm something for me as I found it slightly confusing. This company is an IPC company so the advice seems to be that we appeal but not about the things that we thought were important (mitigating circumstances such as the confusing lines, parking attendant watching, empty car park, confusing signage). We just use the template letter about contractual terms etc. When that is refused, as we will not be referred to POPLA, we just ignore anything else unless/until we get a letter before claim.
In all correspondence we never mention who was driving. We appeal as the keeper of the car.
Have I got this right please? Thank you.
You have go this right.GreenFields wrote: »It was the car park next to Iceland. I'm still a bit confused to be honest. Again, this is correct.
Coupon-Mad (may she live for a thousand years) wrote the NEWBIES thread and says don't bother with the IAS appeal. Others, including myself, say appeal simply because it costs the PPC money whether you win or lose. You then go in to ignore mode unless you get real court papers.
The decision whether to make the second stage appeal is yours. Not appealing then ignoring is less hassle for you. Appealing and then ignoring costs the parking scumpany money and gives you something the PPC would rather not be put in front of a judge.
Whatever you do though, make sure you do the first stage appeal to the PPC using the template letter in the NEWBIES thread, making sure you do not miss the deadline.
edit
The Parking Prankster (may he also live for a thousand years) has recently added this advice concerning second stage appeals to his BlogSpot. In this he suggests requesting the IPC member parking scumpanies use ADR (alternative dispute resolution) run by the Ombudsman Services instead of the IAS appeals as the latter does not meet the legal requirement of ADR. Basically, he is suggesting everyone who gets a rejection from an IPC member scumpany replies with the template letter he has written. This is something the scammers would very much not want to be put in front of a judge and would therefore reduce the chances of it ever getting to court.
