Right, then they are a BPA AOS member and can be 'managed' via POPLA (good news for you, less good news for them now you're getting forum help!).
So ignore anything previously posted re IPC/IAS. Similar PPC name acronyms can lead to confusion.
Now we're clear, it's an initial appeal to the PPC (as per NEWBIES sticky template), then anticipate rejection within 35 days, along with a POPLA verification code. Then it's draft up a POPLA appeal (see NEWBIES sticky, post #3 and search for examples -vs- TR Luckins/ UKPS), adapt it to your circumstances and post here for regulars to skim read (but don't do a 'copy and dump' of the first thing you come across and expect us to sort it all out for you!). Then after regulars' critique, get it off to POPLA for your appeal to be upheld and charge cancelled.
Some work for you to do, but we'll guide you along the way.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thanks mate, after reading a lot of peoples appeals its a scary process for an average joe like me. The wording and examples people give are crazy. I do how ever appreciate the time and effort you guys are putting into this site for the masses, ive only been reading for few hours and my heads already close to exploding.0 -

now that you have clarified which one it actually is, I agree that its popla for appeal, not the one I mentioned

2) yep, definitely naive , or you dont understand what GREED does to these people
3) that argument wont win at popla, no way IMHO
POPLA wont give a monkeys about the nuances you have brought up
they will rule on legal arguments, not mitigation and not the rights or wrongs of the scenario you have brought up
so your popla appeal will have to be based on legal arguments, like no contract, poor signage , NTK flaws , not a gpeol , the use of cctv pictures etc

Hello all im back.
So I followed the newbie guide and I sent my appeal to the PPC at the 3rd week. They have replied to my appeal and putt he popla code in motion 5 days after. The NTK states they have 56 days (if im right) but my popla deadline is way before the 56 days. If I use this argument about no keeper liability can they not just draft out a well written NTK after I have submitted the appeal to popla?0 -

Just get your POPLA appeal registered as you have a few weeks to refine the content. (POPLA are changing "managing companies" from OCTOBER 1st) Just go to their web site and read what you need to do.0 -
Sorry, I'm a little confused now ...
Judging by the deadlines quoted, I am thinking when you say NTK, you are actually referring to the window ticket which is the Notice to Driver (NTD). Did you appeal the window ticket or something that came through the post? (reading back, I see you may have appealed to the NTD as keeper before receiving the NTK?)
The NTD will quite rightly state 56 days as they may claim keeper liabilty through the issue of a Notice to Keeper (NTK) after 28 days and then may start proceedings to reclaim the charge from the keeper a further 28 days after the NTK is given (28 + 28 = 56) providing you have not appealed the charge (which you have).
You should now ignore the 56 days, and go by the POPLA deadline.
Basically each stage has its own deadline timescale which resets the clock.
I'm not sure if the PPC can still issue an NTK, but if you appealed the NTD as keeper, I see no reason why they should need to?0 -
