paking fine court?

We received a parking fine for parking on private land for 5mins, I am disabled and needed the toilet. Anyway cutting a long storey court we received letter saying that they had taken us to court an won. We have had no court papers notifying us of this fact, or any ccj's as there threatening letter suggested. Now threatening ballifs to attend. Advice please.

Not receiving papers is a good reason for getting a set aside.
You also need a good reason to win a re-hearing. Leaving within a grace period is a possible option given the limited info you gave, but there is also level of charge, signage, right to issue charges, etcDedicated to driving up standards in parking0 -
Which PPC?
Have you contacted the court (not the PPC) and checked?
If it's genuine, then you'll need to get a setaside, and they countersue under the Equalities Act.0 -
I think they mention Northampton something centre in the letter... Trouble is I have moved house and my full time carer has lost the paper work in the process..Grrr Now I have no idea how to get on top of this... Help please.0

you need to find the paperwork and give more details
name of company that took you to court
date of the alleged contravention
then read the sticky threads about paying £155 for a set aside and then go to court and defend yourself
as an aside , think about counter-suing under the EA2010, including both the landowner and the parking company in your complaint0 -

If things are as you say, you will not have to pay a penny in the long run, and you may be able to turn a profit, but you have to get a grasp on the process, be pro-active, and play hardball. These companies are scum, play them at their own game, and keep all documents.
The fact that you are disabled and have a full time carer will not cut it, they will see you as easy prey.You never know how far you can go until you go too far.0 -
If you have lost everything, ask the bailiffs for the full details. They will be obliged to provide to with them. You can then start the set aside process.

File a N244 application from the court website to stop the enforcement and collection.
You might want to give this full time care person a kick up the backside as well.
You will need to research a defence and counterclaim a substantial compensatory amount for breech of equality act, really go at them and the landowner jointly hard.
Make the landowner sit up and realise what they have got mixed up in.I do Contracts, all day every day.0 -

Have a look at it so you can see what information you need. You can either ask the balliff who took you to court or join a free site like Noodle to get a credit check on yourself.0 -
I do wonder if this is even a bailiff, the ppc's use this term to frighten people as its often just a tame debt collector. As I read the post they are just threatening to send bailiff, as yet no proof that the court system was even gone through.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0
