You have a claim form, you can't just randomly make a lower payment and hide your head in the sand. You need to defend it and follow the court process - no-one has to go to Northampton. We have advice here telling people exactly what to do when, and we'll help a person trying to do so.
We have replied to you on your thread but maybe you and this poster and jollymonkeys can discuss your defences by private message then show us what you come up with. Discussing this together by pm may help you, no need to show us on the open forum.
BTW, solicitor letters are VERY OFTEN not signed by a person by name. It's normal.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello... sorry for just jumping in as a newbie. The CAB pointed me here as I too am a victim of Excel Parking and BW Legal.
Last year I cut through their car park in Chorlton on my way to the garage to take my car for an MOT. I cut through again on my way home later in the afternoon after picking my car up. I never parked there and never have before. Their ccvtv camera has taken a snap shot of me driving in and later driving out on my way home and claim I had been parked there all day. I sent them a copy of my MOT certificate which has both the date and the time on it, but they claim to have not received it in time for the appeal. For a whole year I have been hounded by debt collection agencies and every time sent them a copy of my MOT as proof.. my car could not be in 2 places at the same time! Now BW Legal have started court proceedings, and I am at the Small Claims Track form process with an upcoming Small Claims Mediation Service. I have a letter from the garage owner who has confirmed on his letter headed paper that my car was in his garage and was MOT'd that day from morning until late afternoon.. during the time Excel claim it was in their car park.
What I don't understand is WHY are they perusing this when I have presented proof? Why do they think they have a chance of winning and getting over £200 out of me for simply cutting through their car park?! Can anyone give me advise on this as I have never been in this position before?0 -

Don't bother to build up any hopes re the so-called Mediation 'Service'. Be ready to end the call early, it is pointless, you owe the parking firm nothing but the MS will be pressing YOU to 'settle'! Because no-one at Excel or BW Legal has really looked at your responses properly and they are buoyed by the Beavis case and think they can railroad a win. Or that you will drop the ball whcih would get them a default win/CCJ. You haven't dropped the ball so good on you.
I expect they will discontinue before the hearing but if they do call or write to tell you that, NEVER believe them until you have checked with your local court. You are expected to be at the hearing and MUST turn up, unless the court themselves confirm it's discontinued.
Have you sorted out your defence for the hearing yet? Sent the defence to the relevant parties and court? Got a date in July for a hearing?

I don't really have any 'defense' as such apart from my MOT certificate and the letter from the garage owner.. he also said they are welcome to contact him. Just got the mediation service form today so have to post that back to the courts tomorrow.
This is honestly stressing me out and has made me ill with worry, but I will not pay this on principle as I never parked there! Excel Parking are committing fraud by extorting money out of innocent people and it is so so wrong! If I didn't have my MOT certificate as proof I don't know how I would defend myself against these tyrants!0 -
